   مقررات گذاری در اقتصاد دریاپایه ایران در پرتو حقوق بین الملل و حکمرانی داخلی

چکیده    اقتصاد دریاپایه به عنوان موتور محرک توسعه پایدار، تنها منحصر به شیلات و حمل‌ونقل نیست، بلکه حوزه‌های نوینی مانند گردشگری دریایی، انرژی‌های تجدیدپذیر و بیوتکنولوژی دریایی را در بر می‌گیرد. این گستردگی، نیازمند نظام حکمرانی و مقررات‌گذاری هوشمند، منعطف و یکپارچه است. مقاله حاضر با روش توصیفی-تحلیلی و با بررسی اسناد بین‌المللی (مانند unclos)، قوانین داخلی ایران و مطالعه موردی نروژ، به واکاوی چالش‌های مقررات‌گذاری در این حوزه می‌پردازد. یافته‌ها نشان می‌دهد مهم‌ترین موانع، پراکندگی مراجع تصمیم‌گیری، تعارض منافع اقتصادی-زیست‌محیطی، نبود داده‌های یکپارچه و خلاهای حقوقی در حوزه‌های نوین (به‌ویژه گردشگری دریایی) هستند. مقاله با افزودن بخش تخصصی به تحلیل ابعاد حقوقی-قضایی گردشگری دریایی می‌پردازد و در پایان، الگویی بومی برای مقررات‌گذاری یکپارچه مبتنی بر هماهنگی نهادی، پایش دیجیتال، تقویت نظام قضایی تخصصی و مشارکت ذی‌نفعان پیشنهاد می‌دهد. این پژوهش می‌تواند چارچوبی برای سیاست‌گذاران و قانون‌گذاران در راستای بهره‌برداری خردمندانه و بهتر از دریا را فراهم آورد.

   regulation in iran's maritime-based economy in the light of international law and domestic governance

Abstract    the maritime-based economy, as an engine of sustainable development, is not limited to fisheries and transportation but also encompasses emerging fields such as marine tourism, renewable energy, and marine biotechnology. this breadth necessitates an intelligent, flexible, and integrated system of governance and regulation. this article, employing a descriptive-analytical method and by examining international instruments (such as unclos), iran s domestic laws, and a case study of norway, scrutinizes the challenges of regulation in this domain. findings indicate that the most significant obstacles are the dispersion of decision-making authorities, conflicts between economic and environmental interests, the absence of integrated data, and legal gaps in emerging sectors (particularly marine tourism). the article adds a specialized section analyzing the legal-judicial dimensions of marine tourism and ultimately proposes a native model for integrated regulation based on institutional coordination, digital monitoring, strengthening the specialized judicial system, and stakeholder participation. this research can provide a framework for policymakers and legislators towards the wise utilization of the sea.
