corporate liability of oil companies for climate damages: examining the role of the precautionary principle and the due diligence standard in european and u.s. judicial practice

Authors
Abstract    the liability of oil companies for climate damages is a critical issue in environmental law and corporate responsibility, attracting widespread global attention in light of the increasing impacts of climate change. this article aims to analyze the application of the precautionary principle and the due diligence standard in european and u.s. judicial practice, providing both theoretical and practical frameworks for corporate responsibility regarding climate-related harms. in the theoretical framework section, concepts such as corporate liability, climate damages, the precautionary principle, and the due diligence standard are examined, highlighting the importance of integrating preventive and operational principles for effective environmental risk management. subsequently, prominent european cases, including urgenda v. netherlands, milieudefensie v. shell, and lawsuits against oil companies, are analyzed to illustrate how the precautionary principle and due diligence standard are applied in judicial decisions. in the u.s. judicial context, cases such as massachusetts v. epa and kivalina v. exxonmobil are reviewed, showing that despite the focus on establishing direct causation, the standards of reasonable care and due diligence enable companies to mitigate liability and manage risks effectively. the comparative section examines structural and legal differences between europe and the u.s., analyzing the strengths and limitations of each system in implementing proactive and accountable corporate responsibility. furthermore, key similarities, such as the emphasis on prevention, transparency, and the application of operational standards in both jurisdictions, are highlighted. the findings of this study indicate that combining the precautionary principle with the due diligence standard can provide an effective framework for preventing climate damages, enhancing corporate accountability, and harmonizing legal obligations with social responsibility. this analysis underscores the importance of establishing global and preventive standards for corporate liability regarding climate-related harms and offers a clear pathway for the development of policies and judicial practices centered on responsible corporate governance.
