   بررسی علمی-حقوقی تعاریف و خلاهای حقوقی نواحی ساحلی در قوانین ایران

چکیده    مقاله حاضر به بررسی علمی-حقوقی تعاریف و چارچوب‌های حقوقی مرتبط با نواحی ساحلی و مرز میان خشکی و دریا در قوانین ایران می‌پردازد. با وجود اهمیت استراتژیک و زیست‌محیطی نواحی ساحلی، قوانین فعلی ایران فاقد تعاریف دقیق، منسجم و هماهنگ از مفاهیم کلیدی مانند خط ساحل، خط کرانه، خط مبنا و حریم‌های ساحلی هستند که این امر موجب بروز ابهامات و چالش‌های حقوقی و مدیریتی در تعیین مرزها و مالکیت اراضی ساحلی می‌شود. در این مطالعه، خلاهای موجود در نظام حقوقی ایران با استفاده از تحلیل فنی-علمی و مقایسه تطبیقی با نظام‌های حقوقی بین‌المللی توسعه‌یافته بررسی گردیده است. نتایج نشان می‌دهد که نبود قانون جامع دریایی-ساحلی و مرجع تخصصی برای تعیین و پایش خطوط ساحلی، مانع مدیریت یکپارچه و پایدار نواحی ساحلی شده است. این مقاله بر ضرورت تدوین قانونی یکپارچه و علمی تاکید می‌نماید که ضمن بهره‌گیری از دانش فیزیک دریا و داده‌های هیدروگرافیکی، سازوکارهای حقوقی انعطاف‌پذیر و هماهنگ با تحولات محیطی و اقلیمی را پیش‌بینی کند تا امنیت حقوقی، حفاظت محیطی و توسعه پایدار سواحل ایران تضمین شود.

   scientific–legal analysis of definitions and legal gaps of coastal zones in iranian law

Abstract    this paper presents a scientific–legal analysis of the definitions and legal frameworks governing coastal zones and the land–sea interface in iranian law. despite the strategic, environmental, and socio-economic importance of coastal areas, the existing legal system in iran lacks precise, coherent, and harmonized definitions of key concepts such as the shoreline, coastline, baseline, and coastal buffer zones. this deficiency has resulted in significant legal, administrative, and managerial ambiguities, particularly in the determination of coastal boundaries and land ownership. in this study, the existing legal gaps within iran’s coastal regulatory framework are examined through an integrated technical–scientific analysis combined with a comparative review of developed international legal systems. the findings indicate that the absence of a comprehensive coastal–marine law and a specialized authority responsible for defining, delineating, and monitoring coastal lines has hindered integrated and sustainable coastal management in iran. the paper emphasizes the necessity of adopting a unified and scientifically grounded legal framework that incorporates principles of physical oceanography and hydrographic data, while also providing flexible legal mechanisms capable of adapting to natural dynamics and climate-driven changes. such an approach is essential to ensure legal certainty, environmental protection, and the sustainable development of iran’s coastal zones.
