the legal evolution of maritime carrier liability in the digital trade documentation system

Authors
Abstract    the digital transformation in maritime commercial documentation has fundamentally altered the nature, legal foundations, and evidentiary principles governing the liability of maritime carriers. utilizing an analytical-comparative approach, this article investigates how the shift from a paper-based to a digital evidentiary system impacts the traditional basis of carrier liability, epitomized by the dichotomy between the presumption of fault and presumption of liability doctrines, and reshifts the burden of proof. findings reveal that the digital environment, through enhanced transparency, precise tracking, and immutable data recording, plays a dual role: it facilitates the claimant s ability to prove that loss occurred during the carrier s period of responsibility while simultaneously enabling the carrier to objectively identify and prove an external cause the cornerstone of the presumption of liability regime to be objectively established. this evolution operationalizes the balanced approach of the rotterdam rules 2008, which anchors liability in its presumption and obligates the carrier to prove exculpatory causes under article 17. conversely, iranian maritime law, entrenched in a translated framework of the 1924 hague rules and silent on electronic documents as well as emerging issues such as compensation for delay and clear regulation of unreasonable deviation, faces significant gaps and ambiguities. the article concludes that aligning with this transformation, whether through accession to the rotterdam rules or by adopting its forward-looking principles in a substantive revision of maritime law, particularly to clarify liability foundations, recognize digital documents, and regulate novel issues, is not merely an option but an imperative necessity to ensure legal certainty and maintain competitiveness in international trade.
