ایفای ناروا

ایفای ناروا یکی از اصطلاحات علم حقوق و به معنای آن است که شخصی بدون وجود حق و سبب قانونی، مالی به دیگری بپردازد. در یک تعریف ساده، ایفای ناروا به معنای پرداختی است که منشا دینی ندارد. به این معنا که اگر شخصی دینی را به دیگری با این تصور که به وی مدیون است بپردازد، اما بعداً مشخص شود که چنین دینی اصلاً وجود نداشته است و شخص در واقع مدیون نبوده، چنین پرداختی ایفای ناروا است. ایفای ناروا به شرایطی اشاره می کند که شخصی بدون سبب قانونی و یا بدون هیچگونه تعهدی با این تصور که مدیون است، مالی را به دیگری پرداخت نماید. در حالت کلی ایفا یا ادای دین در شرایطی تعریف می شود که تعهد یا سبب قانونی برای پرداخت آن وجود داشته باشد. در غیر این صورت هیچ الزام و اجباری برای آن وجود ندارد و قانون پاره ای قوانین و اصول را برای آن در نظر گرفته است. مبحث ایفای ناروا برگرفته از مباحث ایفای تعهدات است که در قوانین فقهی به آن اشاره شده و از این طریق به متون قانونی ما راه یافته است. شرایط ایفا ناروا پرداخته شده است این ضرایط عبارتند از: ایفا دین، ناروایی این ایفا و اشتباه بودن ایفا است . در حقیقت ایفای ناروا زمان تحقق می یابد که یکی از طرفین گیرنده ی مال یا دهنده ی آن در مقام قانونی آن قرار نداشته باشند و سببی برای حق آنها شناخته نشود.
