a review of the new challenges of the law of the sea and maritime governance in the 21st century: the transition from delimitation to ecosystem management

Authors
Abstract    the paradigm shift in the law of the sea from territorial division to integrated ecosystem management represents the most significant legal and governance challenge of the twenty-first century. this transition has emerged in response to pressures from climate change, the industrialization of the oceans, and efforts to protect marine biodiversity. the existing legal framework, primarily based on the 1982 united nations convention on the law of the sea (unclos), with its state-centric and sectoral approach, possesses limited capacity to address today s complex, transboundary, and ecosystem-based challenges. through an analysis of international legal documents, reports from specialized organizations, and contemporary research literature, this article argues that achieving effective maritime governance necessitates the adoption of integrated coastal zone management (iczm) principles, an ecosystem-based management (ebm) approach, and the strengthening of supranational institutions. on this path, challenges such as the conflict between economic and environmental interests, weaknesses in enforcement mechanisms, and the need for interdisciplinary knowledge must be addressed. three central questions are posed at the end of the article to illuminate the direction for future research.
