چکیده    فعالیت‌های کشتیرانی به عنوان شریان اصلی تجارت بین‌الملل، علی‌رغم مزایای اقتصادی کلان، همواره تهدیدی جدی برای اکوسیستم‌های دریایی محسوب می‌شوند. این مقاله با هدف تبیین چارچوب مسئولیت شرکت‌های کشتیرانی در قبال خسارات زیست‌محیطی، به بررسی تطبیقی مبانی حقوقی و فقهی این مسئولیت می‌پردازد. روش تحقیق در این مطالعه، توصیفی-تحلیلی با رویکردی کتابخانه‌ای است. یافته‌های پژوهش نشان می‌دهد که در نظام حقوق بین‌الملل، به ویژه در کنوانسیون بین‌المللی مسئولیت مدنی ناشی از خسارات آلودگی نفتی (clc 1992)، اصل «مسئولیت مطلق» مالک کشتی بدون نیاز به اثبات تقصیر پذیرفته شده است ازسوی دیگر، در فقه اسلامی، قواعدی چون «لاضرر»، «ضمان اتلاف» و «تسبیب»، مسئولیت جبران خسارت وارده به محیط‌زیست و اشخاص ثالث را به‌وضوح مقرر می‌دارند. بررسی الحاق ایران به کنوانسیون clc حکایت از تفسیر این تعهد بین‌المللی با توجه به مبانی فقهی دارد؛ به‌گونه‌ای که مسئولیت مطلق، منوط به تحقق خسارت واقعی دانسته شده است. این همگرایی بین حقوق بین‌الملل و اصول فقهی، چارچوبی محکم برای الزام شرکت‌های کشتیرانی به رعایت ملاحظات زیست‌محیطی، مدیریت ریسک و جبران کارآمد خسارات فراهم می‌آورد. مقاله حاضر با ارائه این تحلیل جامع، گامی در جهت تقویت ادبیات حقوقی-فقهی اقتصاد دریاپایه و ترویج توسعه پایدار در فعالیت‌های دریایی برمی‌دارد.

   legal and jurisprudential responsibility of shipping companies regarding marine environmental damage: analysis of obligations and solutions

Abstract    shipping activities, as the main artery of international trade, despite their large-scale economic benefits, have always been a serious threat to marine ecosystems. this article aims to explain the framework of shipping companies’ responsibility regarding environmental damage, examining the comparative basis of legal and jurisprudential principles of this responsibility. the research method in this study is descriptive-analytical with a library-based approach. the findings show that in the international legal system, especially in the international convention on civil liability for oil pollution damage (clc 1992), the principle of absolute liability of the shipowner without the need to prove fault has been accepted. on the other hand, in islamic jurisprudence, rules such as no harm, guarantee for loss, and attribution clearly stipulate the responsibility to compensate for damage caused to the environment and third parties. examination of iran’s accession to the clc convention indicates an interpretation of this international commitment with consideration of jurisprudential principles; in such a way that absolute liability is contingent upon the actual occurrence of damage. this convergence…... provides a robust framework for obligating shipping companies to adhere to environmental considerations, risk management, and effective damage compensation. the present article, by presenting this comprehensive analysis, takes a step towards strengthening the legal-jurisprudential literature of the blue economy and promoting sustainable development in maritime activities.
