Abstract
the digital age, by providing unprecedented capabilities for the collection, storage, and analysis of citizens personal big data, has furnished governments with extraordinary analytical tools that are vital for strengthening national security. these advanced tools play a crucial role in the proactive prevention of organized crime, the effective countering of cyber and traditional terrorism threats, as well as the rapid and efficient management of national crises, contributing to the preservation of stability and social order. nevertheless, the increasing use of these surveillance technologies simultaneously raises serious and fundamental challenges regarding individual freedoms and the right to citizens privacy, which can lead to the curtailment of fundamental democratic rights. this article aims to provide specific operational solutions and policy frameworks for establishing a necessary and just balance between the requirements of national security and the protection of civil rights. it achieves this by thoroughly examining the legal principles governing digital surveillance, analyzing the technical tools used in data monitoring, and conducting a comparative study of the legal challenges and successful or unsuccessful experiences of various countries around the world. the results obtained clearly indicate that success in this domain depends on the adoption of clear, explicit, and proportionate laws tailored to needs, the establishment and strengthening of independent and authoritative oversight bodies for monitoring law enforcement, the adoption of novel technological approaches such as privacy by design (pbd), and ultimately, the active participation of citizens and the enhancement of accountability among security institutions. these measures are the main key to creating a stable and reliable balance between public security and civil liberties in today s digital space.
