Abstract
recent climate and environmental developments have caused the concept of maritime governance in international law to face new challenges. on the one hand, rising sea levels, the destruction of marine ecosystems, and disputes over the exploitation of shared resources have revealed the need to revise existing legal rules; on the other hand, the doctrine of the common heritage of mankind, which was established in the 1982 convention on the law of the sea (unclos), is now subject to a reinterpretation based on climate justice and intergenerational responsibility. this article, using an analytical-critical approach, examines the relationship between climate change and maritime governance and assesses the continued legitimacy of the maritime legal order in the face of the environmental crisis and increasing geopolitical competition. the findings show that the existing maritime law system, while institutionally efficient, requires a review of the principles of environmental justice and international cooperation in order to respond to the challenge of maritime security, the protection of the common heritage, and the interests of future generations.
