civil liability of shipping companies in the field of transportation

Authors
Abstract    shipping companies, as operators of maritime transport, bear a heavy civil liability for the goods and passengers they transport. this liability mainly arises from the contract of carriage (bill of lading or passenger ticket) and is based on the principle of fault, meaning that the company is only liable for damages if it proves negligence, negligence or failure to observe the necessary care. according to iranian maritime law, the shipping company is obliged to prepare the ship in terms of seaworthiness, provide equipment, sufficient staff and prepare warehouses and cold stores for the safe transport of goods and to load, move, transport, protect, take care of and unload the goods with full care during the voyage. in the event of damage, loss, weight loss, delay in delivery or damage to the goods, the company is liable unless it proves that the damage was caused by external causes such as force majeure, inherent defect of the goods, fault of the sender or natural hazards of the sea and that it itself has exercised the necessary effort and care. in the transport of dangerous goods, the company s liability is more severe and it must observe special safety measures to prevent pollution or explosion, otherwise it will incur more extensive compensation. the company is also obliged to ensure the safety of passengers, provide appropriate facilities and necessary care during the journey, and is also responsible for the actions of the staff and the ship s master. at the international level, conventions such as hamburg and rotterdam have broadened the liability of the carrier and increased the ceiling of liability limits, although iran has not yet fully joined rotterdam. in cases of ship collisions, the civil liability of the shipping company is also determined based on the degree of fault and compensation is divided in proportion to the share of the fault. ultimately, this civil liability of shipping companies is a combination of contractual, legal and international rules that aim to protect the rights of cargo owners and passengers against the risks of maritime transport and encourage compliance with high safety standards. this legal system attempts to establish a balance between the interests of the carrier and cargo owners so that maritime trade can continue with greater confidence.
