comparative analysis of legal challenges in international marine energy export contracts with emphasis on contractual liability and compensation for damages

Authors
Abstract    international marine energy export contracts, due to the transnational nature of obligations, the multiplicity of applicable legal systems, and the conflict of mandatory national and international rules, face fundamental legal challenges in the enforcement of contractual liability and compensation for damages. this situation, in light of maritime hazards, transboundary environmental obligations, and geopolitical developments, has resulted in a structure based on the intersection of legal systems in the drafting, interpretation, and execution of contractual obligations. the central research question is how effective legal and contractual mechanisms can be established and implemented to ensure the realization of contractual liability and the guarantee of compensation for damages within a transnational legal framework.the research methodology is based on a descriptive-analytical approach, utilizing a comparative analysis of international legal instruments, case law, and specialized contract structures in the field of marine energy exports. the findings indicate that effective enforcement of contractual liability and compensation requires systematic coordination of stabilization and adjustment clauses, specialized marine energy insurance mechanisms, and specialized international arbitration. furthermore, articles 7 and 8 of the 1980 vienna convention, articles 79 and 80 of the united nations convention on contracts for the international sale of goods, and the 1992 civil liability convention for oil pollution play a crucial role in defining standards for attributing breach of obligations, assessing damages, and limiting liability.the study concludes that the design of a standardized and adaptive legal and contractual framework is essential to achieve objectives such as reducing legal risks, enhancing legal certainty, ensuring contractual liability, and facilitating compensation in international marine energy export contracts.
