Abstract
the crisis of overlapping jurisdiction in iran’s marine governance system has, in recent years, become one of the most significant obstacles to effective coastal management. the proliferation of institutions with authority in areas such as environmental protection, fisheries, ports, free zones, tourism, and natural resources has led to fragmented regulations, uneven policy implementation, and institutional conflicts. in this context, the central question is whether the overlap of competencies among marine institutions undermines legal coherence and institutional inefficiency in coastal management or not. based on this, the research hypothesis posits that the absence of clear division of labor and lack of inter-institutional coordination mechanisms has increased administrative conflicts, reduced the efficiency of decision-making and policy implementation in coastal affairs, and ultimately diminished the quality of marine governance. this study, using a descriptive-analytical method and analyzing legal documents, sectoral resolutions, institutional structures, and administrative practices, evaluates the legal and institutional consequences of this overlap. findings indicate that overlapping authorities, legal gaps, and differing interpretations of institutional competencies have not only hindered the realization of integrated coastal management programs but also contributed to increased local conflicts, delays in project implementation, and reduced accountability. the results further suggest that the lack of a coordinating authority at both national and regional governance levels represents a critical gap in iran’s marine legal system. based on these findings, it can be concluded that legal reform based on defining jurisdictional boundaries, strengthening inter-institutional coordination mechanisms, and implementing an integrated coastal governance model are essential prerequisites for improving the efficiency of coastal management and mitigating the crisis of overlapping competencies.
