جایگاه حقوق حریم خصوصی در استفاده از فناوری‌های نظارتی هوشمند در تاسیسات گردشگری ساحلی

امروزه استفاده از فناوری‌های نظارتی هوشمند در تاسیسات گردشگری ساحلی به منظور افزایش امنیت و مدیریت کارآمد فضاها، به یک ضرورت تبدیل شده است. با این حال، این فناوری‌ها می‌توانند حریم خصوصی گردشگران را به مخاطره اندازند، به‌ویژه در شرایطی که چارچوب قانونی مشخص و استانداردهای فنی شفاف وجود ندارد. پژوهش حاضر با هدف بررسی جایگاه حقوق حریم خصوصی در استفاده از فناوری‌های نظارتی هوشمند در تاسیسات گردشگری ساحلی انجام شده است. یافته‌ها نشان می‌دهد که نبود قانون اختصاصی، فقدان نظام نظارت مستقل، ضعف استانداردهای فنی، کمبود آموزش و آگاهی گردشگران و کارکنان، و عدم شفافیت در مدیریت داده‌ها، مهم‌ترین عوامل تهدیدکننده حریم خصوصی هستند. همچنین مشخص شد که رعایت اصول حداقل‌گرایی داده، رضایت آگاهانه، محدودیت هدف و شفافیت، نه تنها الزامی حقوقی و اخلاقی است، بلکه می‌تواند اعتماد گردشگران را افزایش داده و تجربه گردشگری را بهبود بخشد. این پژوهش تاکید می‌کند که برای بهره‌برداری مسئولانه از فناوری‌های نظارتی، رویکردی میان‌رشته‌ای شامل اصلاح قوانین، تدوین استانداردها و پروتکل‌های فنی، فرهنگ‌سازی و آموزش و استفاده از فناوری‌های کاهش مداخله ضروری است.

the legal status of privacy rights in the use of smart surveillance technologies in coastal tourism facilities

today, the use of smart surveillance technologies in coastal tourism facilities has become essential for enhancing security and efficient management of spaces. however, these technologies may threaten tourists privacy, especially in the absence of clear legal frameworks and transparent technical standards. this study aims to examine the legal status of privacy rights in the use of smart surveillance technologies in coastal tourism facilities and to identify the challenges and possible solutions for responsible deployment of these technologies. the findings indicate that the lack of specific legislation, absence of independent oversight, weak technical standards, insufficient awareness and training of tourists and staff, and lack of transparency in data management are the main factors jeopardizing privacy. furthermore, adherence to the principles of data minimization, informed consent, purpose limitation, and transparency not only fulfills legal and ethical obligations but also enhances tourists’ trust and improves their overall experience. the study emphasizes that a multidisciplinary approach including legal reform, technical protocols, awareness and training programs, and the use of privacy-preserving technologies is essential for responsible use of surveillance technologies in coastal tourism facilities.
