چکیده    حمل‌ونقل دریایی به عنوان ستون فقرات تجارت جهانی، همواره با ریسک‌های گوناگونی از جمله تصادم، غرق‌شدن و آلودگی‌های زیست‌محیطی همراه است که آثار آن اغلب فراتر از مرزهای ملی گسترش می‌یابد. هدف اصلی این پژوهش، تحلیل مبانی نظری و مقررات قانونی حاکم بر مسئولیت مدنی در حوادث دریایی و بررسی تطبیقی نظام حقوقی ایران با کنوانسیون‌های بین‌المللی است. مسئله اصلی تحقیق، واکاوی چگونگی جبران خسارت در تقابل میان قوانین سنتی مبتنی بر تقصیر و نیازهای مدرن دریانوردی است.یافته‌های این پژوهش نشان می‌دهد که نظام حقوقی ایران، که عمدتاً بر پایه «قانون دریایی مصوب 1343» استوار است، همچنان بر نظریه سنتی «تقصیر» تاکید دارد . این در حالی است که اسناد بین‌المللی نظیر کنوانسیون‌های مسئولیت مدنی ناشی از آلودگی نفتی (clc) و مقررات هامبورگ، با درک خطرات نوین و فاجعه‌بار دریایی، به سمت پذیرش «مسئولیت محض» (بدون تقصیر) و «مسئولیت تضامنی» گرایش یافته‌اند . بررسی‌ها حاکی از آن است که قوانین داخلی ایران به دلیل قدمت و عدم به‌روزرسانی، در مواجهه با حوادث پیچیده مدرن (مانند آلودگی‌های شیمیایی و تصادم‌های الکترونیکی) دارای خلاهای جدی بوده و بازدارندگی لازم را ندارند.این مقاله ضمن بررسی انواع مسئولیت‌های قراردادی و قهری، نقش حیاتی بیمه‌های دریایی و باشگاه‌های حمایت و غرامت (p&i) را در جبران خسارت تحلیل کرده است . همچنین چالش‌های حقوقی مرتبط با «محدودیت مسئولیت مالکان کشتی» و تفاوت رویکرد کنوانسیون‌های لاهه و روتردام در خصوص «خطای ناوبری» مورد ارزیابی قرار گرفته است. در نهایت، نتایج پژوهش لزوم بازنگری فوری در قانون دریایی ایران و جایگزینی نظریه مسئولیت محض در خسارات زیست‌محیطی را اثبات می‌کند . همچنین پیشنهاد می‌شود جهت یکسان‌سازی رویه‌های قضایی با استانداردهای جهانی، ایران به کنوانسیون‌های نوین مانند پروتکل‌های اصلاحی llmc و قواعد روتردام ملحق شده و ساختار بیمه‌های دریایی خود را تقویت نماید.

Abstract    maritime transport, as the backbone of global trade, is always associated with various risks such as collision, sinking, and environmental pollution, the effects of which often extend beyond national borders. the main objective of this study is to analyze the theoretical foundations and legal regulations governing civil liability in maritime accidents and to provide a comparative study of the iranian legal system vis-à-vis international conventions. the central issue of the research is to investigate the mechanism of compensation in the confrontation between traditional fault-based laws and modern maritime needs. the findings indicate that the iranian legal system, which is mainly based on the maritime act of 1964, still emphasizes the traditional theory of fault. this is while international instruments such as the civil liability conventions for oil pollution damage (clc) and the hamburg rules, recognizing modern and catastrophic maritime risks, have tended towards accepting strict liability (no-fault) and joint and several liability. the reviews suggest that due to antiquity and lack of updates, iran s domestic laws suffer from serious lacunae in facing complex modern accidents (such as chemical pollution and electronic collisions) and lack the necessary deterrence. this article, while examining various types of contractual and non-contractual (tort) liabilities, analyzes the vital role of marine insurance and protection and indemnity (p&i) clubs in compensation. furthermore, legal challenges related to shipowners limitation of liability and the difference in the approach of the hague and rotterdam conventions regarding navigation fault have been evaluated. ultimately, the results prove the necessity of an urgent revision of the iranian maritime law and the substitution of the strict liability theory in environmental damages. it is also suggested that, in order to harmonize judicial procedures with global standards, iran should accede to modern conventions such as the corrective protocols of the llmc and the rotterdam rules, and strengthen its marine insurance structure.
