Abstract
the objective of this research is a comprehensive and analytical examination of the structural and operational causes contributing to the failure of municipal quasi-judicial commissions (or municipal disciplinary commissions) to fully realize citizens rights and the principles of fair trial (due process). despite their vital role in regulating urban legal relations, these commissions have become a primary source of public dissatisfaction, evidenced by the escalating statistics of legal complaints. the research methodology relies on documentary and library-based data collection. for the analysis section, the meta-summary method was employed to integrate, interpret, and explain the key causes and factors of this issue. the findings indicate that this failure stems from the convergence of weaknesses across three levels: structural and philosophical weaknesses: the most critical issue is the dominance of a financialization and speculative paradigm over the rule-of-law function of the municipality. this system monetizes violations (fines) and reinforces structural corruption. procedural and executive defects: these include the violation of the principle of equality of arms and the citizen s right to defense, the lack of special and transparent rules of procedure (due process), and the single-stage nature of proceedings in key authorities, which undermines citizens legal security. management weaknesses: these involve a lack of transparency and accountability aligned with good governance indicators. the conclusion asserts that improving the status of citizens rights necessitates a paradigm shift and deep structural reform. these reforms must focus on formulating a fair and binding code of procedure, mandating the right to appeal (judicial review), and most importantly, cutting the financial dependency of municipalities on violation fines. this is essential for these authorities to transition their nature from a focal point of rights infringement to a guarantor of urban justice and discipline.
