Abstract
this study aims to provide a comparative analysis of the urban environmental law systems in iran and several leading asian countries (japan, south korea, india, malaysia, and china). the research primarily focuses on analyzing the structure of higher legal instruments, national laws governing urban environmental management, and the operational models of environmental governance at the local level. in iran, despite the existence of strong legal foundations such as article 50 of the constitution and the enactment of key statutes like the clean air act (2017) and the waste management act (2004), fundamental challenges remain regarding implementation, including pronounced institutional fragmentation among municipalities, islamic councils, and the department of environment, as well as weak mechanisms for effective enforcement. in contrast, the selected asian countries—particularly japan and south korea—have advanced towards participatory and efficient governance by embedding green governance structures at the local level, defining active roles for citizens, and utilizing technology-driven models and specialized courts (such as green tribunals in india). the findings of this research demonstrate that reforming the institutional structure, establishing a unified and robust body for harmonized environmental governance in urban areas, enhancing active citizen participation in decision-making, and digitalizing oversight and monitoring processes can serve as the basis for a fundamental transformation in iran’s urban environmental governance and help bridge the gap between law and practice.
