چکیده
|
خانواده بهعنوان نخستین و بنیادیترین واحد اجتماعی، نقشی بسیار مهم در شکلگیری و پایداری جوامع ایفا میکند. حفظ و صیانت از این کانون مقدس، مستلزم تبیین و اجرای وظایف و تعهدات متقابل زوجین است. از جمله این تعهدات، مسئولیتهای مالی شوهر در قبال همسرش میباشد که عدم انجام صحیح آنها میتواند به بروز مشکلات جدی و بحرانهای اجتماعی از جمله طلاق بینجامد. در این میان، شناسایی ضمانت اجراهای موثر برای تضمین ایفای این تعهدات، امری ضروری است. مقاله حاضر به بررسی ابعاد مختلف وظایف مالی شوهر در قبال همسر در محیط خانواده و تحلیل ضمانت اجراهای نقض این تعهدات از منظر فقه امامیه و حقوق ایران میپردازد. پرسش اصلی این مقاله آن است که: «مهمترین تعهدات مالی زوج در مقابل زوجه چیست و ضمانت اجرای شرعی و قانونی هریک کدام است؟» با تحلیل متون فقهی و حقوقی، مهمترین تعهدات مالی شوهر شامل مهریه، نفقه، اجرت المثل و نحله، همراه با ضمانت اجراهای مدنی، کیفری و فقهی هر یک مورد بررسی قرار میگیرد. یافتهها نشان میدهد که نظام حقوقی ایران با بهرهگیری از فقه اسلامی، ابزارهای متنوعی از جمله اجرای ثبت محضری، جلب، حبس، حق حبس زوجه، جزای نقدی و حتی در مواردی حق درخواست طلاق توسط زن را برای تضمین این حقوق پیشبینی کرده است. در نهایت، این تحقیق نشان میدهد که آگاهی از این ضمانت اجراها نه تنها به تحکیم بنیان خانواده از طریق پیشگیری از اختلاف کمک میکند، بلکه راهکار عملی مناسبی برای زوجه در صورت نقض حقوقش فراهم میآورد.

Abstract
|
the family, as the first and most fundamental social unit, plays a very important role in the formation and sustainability of societies. preserving and safeguarding this sacred center requires explaining and implementing the mutual duties and obligations of the spouses. among these obligations are the husband's financial responsibilities towards his wife, the failure to fulfill which can lead to serious problems and social crises, including divorce. in the meantime, identifying effective guarantees of execution to ensure the fulfillment of these obligations is essential. the present article examines the various dimensions of the husband's financial obligations towards his wife in the family environment and analyzes the guarantees of execution for the violation of these obligations from the perspective of imami jurisprudence and iranian law. the main question of this article is: what are the most important financial obligations of the husband towards his wife and what is the guarantee of the religious and legal implementation of each? by analyzing jurisprudential and legal texts, the most important financial obligations of the husband, including dowry, alimony, wages for the wife, and the nahleh, are examined, along with the civil, criminal, and jurisprudential guarantees of each. the findings show that the iranian legal system, utilizing islamic jurisprudence, has foreseen various tools, including notarial registration, arrest, imprisonment, the wife's right to imprisonment, fines, and even, in some cases, the right to request divorce by the wife, to guarantee these rights. finally, this research shows that awareness of these guarantees of execution not only helps to strengthen the foundation of the family by preventing disputes, but also provides a suitable practical solution for the wife in the event of a violation of her rights.
