چکیده
|
جرایم سازمانیافته تهدیدی بالقوه برای حقوق بشر میباشد و کرامت انسانی و عدالت را در تنگنا قرار داده است. شبکه جنایی با نیروی فقر، حکومتداری ضعیف و مرزهای دیجیتال، از نقاط ضعف انسانی به عنوان ابزاری در حرکتهای غیرقانونی خود استفاده میکند. این تهدید به دنیای دیجیتال نیز سرایت نموده و جرایم سایبری و سرقت هویت، حریم خصوصی و آزادی را از بین میبرند. باید اذعان نمود که ریشههای این بحران در شبکهای پیچیده از نابرابریهای اجتماعی-اقتصادی، چهارچوبهای قانونی سهلانگارانه و ساختارهای فاسد میباشد و لذا، ورود آنها به جامعه، مبارزه و مقابله با آنها نیازمند اقداماتی گسترده است. در همین راستا، این پرسش مطرح می گردد که جرائم سازمان یافته چگونه بر موازین حقوق بشری تاثیر میگذارند و چه تمهیداتی جهت حمایت از حقوق بشر در مبارزه با جرائم سازمان یافته میتوان اتخاذ نمود. در پاسخ میتوان اولین اقدام را تقویت چهارچوب قانونی، توانمندسازی نیروهای انتظامی و امنیتی و رسیدگی منصفانه به بیعدالتیهای اساسی دانست. همکاری بینالمللی و ایجاد فرهنگ شفافیت و پاسخگویی، میتوانند گام دوم در این نبرد باشند. همچنین، این امر ضرورت هوشیاری مداوم، تلاش بیوقفه در راستای رسیدن به عدالت و جامعهای کارآمدتر در مواجهه با جرایم سازمانیافته را مطالبه مینماید. این پژوهش به روش توصیفی تحلیلی حقیقت تلخ تاثیر مخرب جرائم سازمان یافته بر حقوق بشر را از ریشههای تاریخی تا تجسمهای مدرن آن آشکار میکند و به این نتیجه میرسد که مقابله با نقض حقوق بشر توسط جرایم سازمانیافته، نیازمند رویکردی همهجانبه است تا به علل اساسی بپردازد، نهادها را تقویت کند و جوامع را توانمند سازد. بنابراین،ارتقای پاسخگویی، عدالت و کرامت انسانی این امکان را فراهم میآورد تا جهانی عاری از جرایم سازمانیافته ایجاد گردد که در آن حقوق اساسی همگان حافظت شود.

Abstract
|
organized crime poses a potential threat to human rights and undermines human dignity and justice. the criminal network, powered by poverty, weak governance and digital borders, exploits human vulnerabilities as a tool for its illegal activities. this threat has also spread to the digital world, where cybercrime and identity theft destroy privacy and freedom. it must be acknowledged that the roots of this crisis lie in a complex network of socio-economic inequalities, lax legal frameworks and corrupt structures, and therefore, their entry into society, combating and confronting them require extensive measures. in this regard, the question arises as to how organized crime affects human rights standards and what measures can be taken to protect human rights in the fight against organized crime. in response, the first step can be to strengthen the legal framework, empower law enforcement and security forces and fairly address fundamental injustices. international cooperation and the creation of a culture of transparency and accountability can be the second step in this battle. it also requires constant vigilance, relentless efforts to achieve justice and a more effective society in the face of organized crime. this research, using a descriptive-analytical approach, reveals the harsh reality of the destructive impact of organized crime on human rights from its historical roots to its modern incarnations, and concludes that confronting human rights violations by organized crime requires a comprehensive approach that addresses the root causes, strengthens institutions, and empowers societies. therefore, promoting accountability, justice, and human dignity makes it possible to create a world free from organized crime, in which the fundamental rights of all are protected.
