چکیده
|
هر فعل یا ترک فعلی که از انسان سر می زند، دارای اثر است؛ چه ناشی از اضطرار یا غیر آن باشد. استمتاعات جنسی دارای مصادیق متعددی است که عمده بحث در آن به رابطه جنسی بین دو ناهمجنس باز می گردد. استماعات جنسی اضطراری دارای آثاری نسبت به مضطر و طرف مقابل او و نیز نسبت به فرزند متولد از چنین رابطه ای است. هدف از انجام این پژوهش که با روش توصیفی- تحلیلی و بر مبنای منابع کتابخانه ای انجام شده است، این است که آثار شمولیت قاعده اضطرار نسبت به استمتاعات جنسی را در مضطر مورد توجه قرار دهد؛ زیرا قائل شدن به جواز یا عدم جواز آن، نتایج متفاوتی را برای مضطر به همراه دارد. مواردی همچون مسئولیت مضطر، احکام مرتبط با نکاح، مهریه، نفقه، عده و مناصب مشروط به عدالت از جمله آثار این رابطه است. نتایج پژوهش حاضر نشان می دهد که با توجه به ادله اضطرار از جمله حدیث رفع، تا جایی که این آثار برخلاف امتنان شارع نباشد، به نفع مضطر برداشته می شود. همچنین این روابط در هنگام اضطرار ملحق به وطی به شبهه است و ازاین رو، بسیاری از چالش هایی که برای طرفین مضطر وجود دارد، قابل حل است.

Abstract
|
every act or omission that a human being makes has an effect, whether it is due to necessity or otherwise. effects can include both jurisprudential and legal effects. sexual interactions, particularly between two heterosexuals present various scenarios. encounters that occur under duress impact not only the distressed individual and their partner but also any children resulting from these interactions. the aim of this research, which was conducted through a descriptive-analytical approach and utilizing library resources, is to explore the application of the principle of necessity in relation to sexual interactions involving individuals under distress. this investigation is essential, as determining what permissible is or impermissible can lead to significantly different outcomes for the distressed individual. issues such as responsibility of the distressed person, rulings related to marriage, dowry, alimony, waiting period, and matters dependent on justice. the results of this study show that, in light of necessity principles, including the hadith regarding alleviating burdens, any consequences that do not contradict the legislator's benevolence may be mitigated in favor of the distressed individual. moreover, these relationships are connected to tolerance and suspicion in times of emergency, and therefore, many of the challenges that exist for the distressed parties can be resolved.
