تاثیر فناوری‌های نوین بر اجرای معاهدات بین المللی

گسترش فناوری های نوین، به ویژه هوش مصنوعی، بلاک چین و اینترنت اشیا، در دهه های اخیر شیوه های سنتی اجرای معاهدات بین المللی را دستخوش تحول کرده است. پرسش اصلی این پژوهش آن است که این فناوری ها چگونه بر کارآمدی، شفافیت و همکاری های بین المللی در اجرای معاهدات تاثیر می گذارند و در عین حال چه چالش های حقوقی و نهادی را به همراه دارند. فرضیه پژوهش آن است که فناوری های نوین، در صورت بهره گیری در چارچوب های حقوقی و نهادی منسجم و همراه با استانداردهای فنی مشترک، قادرند نقش مکملی در تقویت نظام اجرای معاهدات بین المللی ایفا کنند، اما در صورت فقدان چنین چارچوب هایی، می توانند به تعمیق نابرابری دیجیتال، تشدید تهدیدات سایبری و تضعیف حاکمیت و اعتماد متقابل میان دولت ها بینجامند. پژوهش حاضر با روش توصیفی -تحلیلی و بر پایه منابع کتابخانه ای، اسناد بین المللی و نمونه های موردی در حوزه معاهدات محیط زیستی، تجاری و حقوق بشری، نخست ابعاد مفهومی و کارکردی فناوری های نوین را در فرایند نظارت، گزارش دهی، راستی آزمایی و حل وفصل اختلاف تبیین می کند و سپس فرصت ها و چالش های ناشی از ادغام این فناوری ها در سازوکارهای اجرای معاهدات را تحلیل می نماید. یافته ها نشان می دهد که طراحی چارچوب های حقوقی شفاف، تدوین استانداردهای فنی مشترک، تقویت ظرفیت سازی دیجیتال در کشورهای در حال توسعه و توسعه سازوکارهای همکاری چندجانبه، از پیش شرط های اساسی بهره برداری موثر و مسئولانه از فناوری های نوین در راستای اجرای هرچه کارآمدتر معاهدات بین المللی است.

the impact of emerging technologies on the implementation of international treaties

in recent decades, emerging technologies have significantly transformed the implementation of international treaties. this study aims to examine these impacts and identify the opportunities and challenges associated with integrating technologies such as the internet of things (iot), blockchain, and artificial intelligence (ai) into treaty enforcement. these technologies enhance the speed, accuracy, and transparency of implementation, thereby facilitating more effective intergovernmental cooperation. however, they also pose major challenges, including a lack of standardization, cybersecurity concerns, and the need for coordination among diverse legal systems. the findings of this descriptive-analytical study indicate that emerging technologies can play a complementary role in improving the efficiency of treaty implementation, provided that the necessary legal and institutional infrastructures are in place. key obstacles include cyber threats, the erosion of national sovereignty, and legal gaps. accordingly, the development of coherent legal frameworks, common technical standards, and strong international cooperation are essential strategies for effective integration of these technologies. ultimately, the research highlights that a smart, data-driven approach to utilizing emerging technologies can reduce implementation costs, accelerate execution processes, and enhance transparency in the international treaty system
