تعهد ایمنی در روابط پیمانکاری

از مسائل مهم حقوقی در روابط پیمانکاری موارد، مبنا و نوع تعهد طرفین این رابطه نسبت به ایمنی کار می باشد. مقاله حاضر مسائل یاد شده را با روش توصیفی و تحلیلی کشف و بیان نموده و چنین نتیجه گرفته که تامین ایمنی در انجام کار، محصول کار و محیط کار پیمانکاری ضرورت و موضوعیت یافته و حسب مورد طبق قانون، عرف و قرارداد بر عهده پیمانکار و در مواردی نیز بر عهده صاحبکار است. در این میان تعهدات قراردادی پیمانکار در تامین ایمنی، خاصه به هنگام انجام کار، برجسته تر است. این مهم مبتنی بر مقضیات حکمت بوده و با مبانی فقه اسلامی نیز سازگار می باشد. تعهدات قانونی و قراردادی به ایمنی اصولاً تعهد به وسیله هستند.

one of the significant legal issues in contractual relationships is the basis and nature of the obligations of the parties to this relationship regarding work safety. the present article explores and expresses the aforementioned issues through descriptive and analytical method, concluding that ensuring safety in the execution of work, the product, and the contracting work environment has become necessary and relevant, and is the responsibility of the contractor and, in some cases, to the client, in accordance to law, custom, and contract. notably, the contractor's contractual obligations concerning safety, particularly during the performance of work, are more prominent. this is grounded in rational considerations and also consisted with the principles of islamic jurisprudence. legal and contractual obligations related to safety are basically obligations to the means.
