سیر تکاملی حقوق مالکیت صنعتی در کشورهای غربی و تاثیرات آن بر کشور مالزی

در تاریخچه و منشا پیدایش نظام اختراعات برخی از نویسندگان، اوایل رنسانس در ایتالیا حدود پانزدهم میلادی را منشا تحولات محسوب نموده اند ولی به گواه اسناد تاریخی قانون سولون منتسب به سیاستمدار یونانی به همین نام، منشا پیدایش اولیه این نظام بوده است؛ نظامی مبتنی بر مجوز انحصاری از طرف دولت برای تعاملات و منافع اقتصادی جامعه در صنایع آن زمان. دیگر انواع حمایت ها از طریق نظام صنفی و لطف سلطنتی و... قرن ها پس از آن به وجود آمد که در نهایت در قرن هفدهم شبیه نظام کنونی در جامعه بشری ایجاد گردید که می توان شکوفایی و پیشرفت اقتصادی کشورهای صنعتی را مرهون توسعه این نظام دانست. در مورد علامات تجاری نیز هر چند تمایز بخشی مالکیت نیز پا به پای اختراعات بوده است ولی مفهوم نزدیک به زمان معاصر آن از حدود قرن دهم میلادی می باشد. در مورد نشانه های جغرافیایی نیز هر چند استفاده از آن در یک  محصول خاص در قرن سیزدهم رواج داشته است ولی جنبه فراگیر آن در اوایل قرن نوزدهم بوده است. در این تحقیق با روش تحلیلی- توصیفی و با جمع آوری مطالب به روش کتابخانه ای، سیر این تحول و تکامل را در حوزه حقوق مالکیت صنعتی در مغرب زمین مورد بررسی قرار داده و و تاثیر آن را در کشور اسلامی مالزی مورد بررسی قرار داده ایم؛ به موازات این پیشرفت ها، سلطه استعمار در این کشور، منجر به حاشیه راندن احکام و مبانی فقه اسلامی و پذیرش بی چون و چرای قوانین مالکیت فکری گردید.
