کاربست قاعده نفی سبیل در ‌سیاست‌گذاری ارز دیجیتال ملی برای مقابله با سلطه پولی بیگانگان

ظهور ارزهای دیجیتال بانک مرکزی (cbdc) چشم‌انداز نظام پولی جهانی را با دوگانگی فرصت و تهدید مواجه کرده است. این فناوری ضمن ایجاد ظرفیت برای استقلال اقتصادی، خطر تعمیق «سلطه پولی دیجیتال» توسط قدرت‌های جهانی را نیز به همراه دارد. مسئله اصلی آن است که چگونه می‌توان از این تهدید مصون ماند و از فرصت‌های آن بهره‌مند شد. هدف این پژوهش، تبیین کاربست قاعده فقهی-سیاسی «نفی سبیل» ‌به‌عنوان یک چارچوب راهبردی برای سیاست‌گذاری ارز دیجیتال ملی (ریال دیجیتال) در جهت حفظ و تقویت استقلال اقتصادی است. روش‌شناسی این تحقیق، توصیفی-تحلیلی و مبتنی بر منابع کتابخانه‌ای با رویکردی میان‌رشته‌ای میان فقه سیاسی و اقتصاد سیاسی بین‌الملل است. یافته‌ها نشان می‌دهد که وابستگی فناورانه، پذیرش استانداردهای جهت‌دار و تعامل‌پذیری یک‌طرفه، از مهمترین مصادیق «سبیل» در این حوزه هستند. قاعده نفی سبیل به مثابه یک اصل ایجابی، دولت اسلامی را ملزم به اتخاذ راهبردهایی چون «حاکمیت فناورانه» و «تعامل‌پذیری مدیریت‌شده» می‌کند تا ارز دیجیتال ملی به ابزاری برای مقابله با سلطه اقتصادی تبدیل شود.

an application of the principle of nafi sabil in national digital currency policymaking to counter foreign monetary domination

the emergence of central bank digital currencies (cbdcs) has created a dual landscape of opportunities and threats for the global monetary system. while this technology offers potential for economic independence, it also poses the risk of intensifying digital monetary domination by global powers. the key question is how to remain immune to this threat while benefiting from its opportunities. this study aims to explain the application of the jurisprudential-political principle of nafi sabil (the negation of domination) as a strategic framework for national digital currency (digital rial) policymaking to preserve and strengthen economic independence. the research methodology is descriptive–analytical and based on library resources, adopting an interdisciplinary approach that bridges political jurisprudence and international political economy. findings indicate that technological dependence, biased standards adoption, and unilateral interoperability are among the main instances of domination in this field. as a proactive principle, nafi sabil obligates the islamic state to adopt strategies such as technological sovereignty and managed interoperability, turning the national digital currency into a tool to counter economic domination.
