مطالعه تطبیقی تنوع گرایی در ساختار حقوقی جمهوری هند و افغانستان

یکی از مولفه های مدرن جامعه بشری که در پرتو آن می توان در صلح و آرامش زندگی نمود و مسیر سازگاری و پیشرفت را هموار ساخت؛ تنوع گرایی است، این اصل به دنبال استقرار زندگی مسالمت آمیز میان انسان ها در کنار یکدیگر با وجود داشتن تفاوت ها می باشد. تنوع پذیری به عنوان راه حل تقابل و کشمکش ها پس از آن شناسایی گردید که نس لهای گذشته بشر برای غالب ساختن مذهب، فرهنگ و زبان خویش بر روی دیگران؛ صدها سال با هم جنگیده اند. جمهوری هند از جمله کشورهای است که در آن بیش هزار و هفتصد زبان، هفتاد و دو ملت و صدها فرهنگ و آئین زندگی وجود دارد؛ با این وجود توانسته است تعادل و همسوئی را میان آنها به وجود آورد. افغانستان نیز از جمله کشورهای است که از نظر تنوعات قومی، زبانی و فرهنگی مشابهت های چش مگیری با کشور هند دارد؛ اما این کشور در پذیرش تنوعات همانند هند موفق نبوده است، برای انجام این تحقیق از روش مقایسه ای استفاده می شود، اما سوال این است که تنوع گرایی در نظام حقوقی کشور هند و افغانستان چگونه پیش بینی شده است؟ قانون گذار هند با توجه بهویژگی متکثر جامعه هندی تنوعات مختلف را به صورت شایسته مورد حمایت و پذیرش قرار داده است؛ اما در افغانستان در این زمینه قانون گذاری مطلوب صورت نگرفته است، هدف این تحقیق استفاده از تجارب قانون گزار اساسی هند در خصوص افغانستان می باشد.

one of the modern components of human society, in the light of which it is possible to live in peace and tranquility and a consistent path and made progress smooth. it is diversity, this is a peace be upon the establishment of peaceful life among people. they are next to each other despite having differences. variety,as a solution to confrontation and conflicts after that it was impossible that the past generations of mankind for the most part one’s own religion, culture and language of others; hundreds year together have fought. the republic of india is one of the countries in which more than hundred languages are spoken and seventy-two nations are lived. there are dozens of cultures and ritual s of life; however, power it is necessary to create balance and alignment between them. afghanistan is also among the countries that are diverse ethnic, linguistic and cultural similarities. it has the passion of india, but this country accepts thesame diversity india has not been successful, to do this research of the method comparisons are used, but the question is that the diversity of people that how to vote in the legal system of india and afghanistan has it been seen? legislator of india according to the special pluralistic society of india has different varieties inthe form that has supported and accepted; but in afghanistan in this field, there is no favorable legislation is, the purpose of this research is to use the experiences of the legislator policy of india regarding afghanistan.
