مطالعه تطبیقی ماهیت قراردادهای ورزشی در حقوق ایران و انگلستان

تحقیق حاضر تلاشی در جهت تبیین دیدگاه سیستم حقوقی ایران و انگلستان در خصوی بررسی ماهیت قراردادهای ورزشی به روش توصیفی تحلیلی است و در صدد پاسخ به این پرسش هستیم که ماهیت قراردادهای ورزشی در ایران و انگلستان چیست؟ با دقت به این موضوع که با بررسی ارکان قرارداد ورزشی و مقایسه آن با سایر عقود مشابه می توان ماهیت حقوقی قرارداد ورزشی را تعیین نمود به نظر می رسد در یک جمع بندی کلی ماهیت حقوقی قراردادهای ورزشی در حقوق ایران از جمله قراردادهای خصوصی است و عقد اجازه اشخاص است با تعیین این ماهیت چالش هایی که در عقود مشابه وجود دارد در این مورد راه پیدا نخواهد کرد زیرا قرارداد خصوصی معنایی گسترده داشته و همه موارد مورد بحث در قرار داد ورزشی را در بر می گیرد همچنین با اینکه محدودیت هایی دارد اما تاثیر منفی بر قرارداد ورزشی نمی گذارد بلکه باعث قوام آن می شود اما در حقوق انگلیس ماهیت حقوقی قراردادهای ورزشی تابع قواعد و مقررات قانون کار می باشد.
