سنجش شاخصه‌های تاثیرگذار بر منازعات و ادعا‌های پیمانکاران در شهرداری‌ تهران در سال‌های 1393 تا 1403

پروژه های عمرانی بخش عظیمی از اعتبارات و منابع مالی یک کشور را به خود اختصاص می‌دهند. ادعاها و در پی آن اختلافات به ویژگیهای ذاتی در پروژه های تبدیل شده اند که بسیاری از ذینفعان پروژهها، آن را از مخربترین اتفاقات این صنعت میدانند. در بیشتر پروژه ها با سیستم‌های مختلف انجام پروژه، امکان بروز ادعاهایی از سوی طرفین، به خصوص پیمانکاران وجود دارد. اگرچه در هیچ پروژه ای نمیتوان احتمال بروز این ادعاها را از میان برد، اما میتوان با شناسایی علل و منشا اصلی بروز ادعاها، تا حد زیادی از وقوع آنها در پروژه جلوگیری کرد. پژوهش حاضر با بررسی علل منازعات و ادعاهای پیمانکاران در شهرداری ها صورت پذیرفته است. در تحقیق حاضر با بررسی ادبیات تحقیق عوامل احتمالی موثر بر علل منازعات و ادعاهای پیمانکاران با شهرداری ها شناسایی شده و سپس در قالب پرسشنامه در اختیار 20 نفر از خبرگان و متخصصان قرار گرفته است. در گام اول احتمال وقوع این موارد بین پیمانکاران و شهرداریها، سپس میانگین احتمال تبدیل به اختلاف موارد بین پیمانکاران و شهرداری با استفاده از آزمونهای آماری سنجیده شد و در مرحله بعد با استفاده از روش تحلیل عاملی اکتشافی عوامل اختلاف زا طبقه بندی و میزان احتمال تبدیل هر گروه به اختلاف بررسی شد، در گام سوم، عوامل تاثیر گذار بر اختلاف با استفاده از روش ahp رتبه بندی شدند. نتایج نشان داد شاخص های مربوط به ضعف و نواقص مشاور و ضعف و نواقص کارفرما در بروز اختلاف بین شهرداری و پیمانکاران سهم بیشتری را به خود اختصاص می دهند، در زمینه ضعف و نواقص کارفرما، دخالت کارفرما در اموری مانند طراحی و جزئیات، نحوه ی اجرا و زمان بندی پروژه باعث دو باره کاری و افت راندمان در فعالیتها می شود، همچنین تعلل در تصمیم گری توسط کارفرما مانند تاخیر در بازبینی، تصویب یا ابلاغ تغییرات و سستی در پیشرفت پروژه ها تاثیرگذار است، تعلل در پیش پرداخت برای آماده سازی یا تجهیز کارگاه نیز سبب متضرر شدن پیمانکار و ایجاد اختلاف خواهد شد، تاخیر در اخذ مجوز از سازمانها نیز برعهده کارفرما می باشد که تاخیر در آن سبب کند شدن فعالیت های پروژه می شود و ادعاهای پیمانکاران را در پی خواهد داشت.

measuring the influencing factors on disputes and claims of contractors in tehran municipality (2014-2024)

construction projects significantly contribute to a country's financial resources, yet claims and disputes have become common in these projects. many stakeholders consider these disputes among the most destructive events in the industry. in most projects, there is a possibility of claims from parties, particularly contractors, due to differences in project implementation systems. while eliminating claims is impossible, identifying the primary causes and origins of claims can help prevent them from occurring in projects. this study investigated the causes of disputes and claims by contractors in municipalities. a comprehensive literature review was conducted to identify potential factors affecting disputes and claims. subsequently, a questionnaire was administered to 20 experts and specialists to validate these factors. the probability of disputes occurring and the average probability of these disputes converting into significant differences between contractors and municipalities were measured using statistical tests. exploratory factor analysis was employed to classify the factors causing these differences, and the probability of conversion for each group was analyzed. the analytical hierarchy process (ahp) method was used to rank the factors affecting these differences. the results showed that indicators related to the consultant's weaknesses and shortcomings, as well as those related to the employer's weaknesses and shortcomings, accounted for a significant share in the occurrence of disputes between municipalities and contractors. specific issues such as the execution and timing of projects, duplication of work, delays in decision-making, and delays in obtaining necessary permits were found to contribute to disputes and claims. the study underscores the importance of effective project management, timely communication, and collaboration between contractors and municipalities to minimize disputes and claims.
