رویه شورای نگهبان در بررسی صلاحیت نامزدهای انتخابات ریاست جمهوری 1396-1360

شورای نگهبان بر پایۀ بند 9 اصل 110 قانون اساسی بررسی صلاحیت نامزدهای ریاست جمهوری را انجام می‌دهد و پیش‌بینی اختیار نظارت استصوابی برای این شورا، دایرۀ اختیارات آن را بسیار فراخ ساخته است. شورای نگهبان باید استقلال تام در ابعاد مختلف از مجموعه دایرۀ قوۀ اجرائیه شامل رهبری و ریاست جمهوری داشته باشد، نهایتاً فضای سیاسی و قطب‌بندی جناح‌های سیاسی حاکم بر کشور در هر دورۀ انتخاباتی عوامل اصلی تاثیرگذار در رویکرد کلان و خرد شورای نگهبان در بررسی صلاحیت نامزدهاست. سوال محوری پژوهش حاضر از چگونگی روند تصمیمات شورای نگهبان در ارزیابی صلاحیت یا عدم صلاحیت نامزدهای انتخابات ریاست جمهوری است و روش تحقیق ‌اکتشافی و‌ از نوع تحقیقات کیفی است که با روش تحلیل اسنادی باهدف کمک به مطالعات حقوق اساسی در ایران و ارزیابی بی‌طرفانه‌ای از رویکرد شورای نگهبان در بررسی صلاحیت‌ نامزدهای انتخاباتی ریاست جمهوری انجام می‌گیرد. به نظر می‌رسد شورای نگهبان در ارزیابی خود در خصوص انطباق وضعیت نامزدها با شرایط کیفی مندرج در اصل 115 قانون اساسی رویکردی بسیار تحدیدی و در مواردی جناحی داشته است. در این مطالعه ابتدا جایگاه شورای نگهبان در موضوع نظارت بر انتخابات ریاست جمهوری بحث می‌شود و سپس با ارزیابی روند تصمیمات این شورا در تایید یا رد صلاحیت نامزدها، مقولۀ نظارت استصوابی، میزان استقلال واقعی مرجع نظارت از بدنۀ قوۀ اجرایی کشور و سازوکار رسیدگی به اعتراضات بررسی می‌شود.

the qualifications of presidential candidates are exercised by the guardian council in accordance with article 110 paragraph 9 of the constitution, and the provision of approving oversight powers for this council has greatly expanded its powers. what is the evaluation of factors influencing the process of reviewing the qualifications of presidential candidates by the guardian council? the items that should be studied are: 1. the subject of approving supervision of the guardian council, and its scope in assessing the eligibility of candidates, 2.the set and space of the executive branch in the country, from which the supervisory authority,i.e. the guardian council, should have full independence in various dimensions. the research method in this study, from a legal and political point of view, has a descriptive-analytical nature and is based on documented documents and reports. it seems that the guardian council has taken a very restrictive approach in its assessment of the compliance of the candidates' status with the qualitative conditions set forth in article 115 of the constitution. in this study first, the position of the guardian council on the issue of monitoring the presidential election is discussed and then by evaluating the category of approving supervision, the degree of real independence of the supervisory authority from the executive body and finally the procedure and performance of the council are analyzed.
