اصلاح و بازپروری مجرمان در سیاست جنایی اسلام: مبانی، روش‌ها و اهداف

اصلاح و بازپروری به معنای مجموعۀ اقدامات بهسازی اجتماعی که برای درمان و ارشاد مجرمین به اجتماع انجام می‌گیرد، از جمله سیاست‌های مهم مورد بحث جرم‌شناسان در یکی - دو قرن اخیر است و اهتمام به اصلاح و درمان مجرمان از جمله شاخصه‌های یک سیاست جنایی مطلوب به شمار می‌آید. از دیدگاه اسلام، درمان و بازپروری مجرمان یک ارزش شناخته می‌شود و متون اسلامی لبریز از آموزه‌ها و راهبردهای اصلاحی است. پرسش اصلی پژوهش این است که «سیاست جنایی اسلام چه مبانی، روش‌ها و اهدافی برای اصلاح و بازپروری مجرمان ارائه می‌دهد؟». این مقاله با استفاده از روش تحقیق توصیفی - تحلیلی و بررسی متون اسلامی، درصدد واکاوی ماهیت و ابعاد بازپروری و اصلاح مجرمان در سیاست جنایی اسلام است. یافته‌های پژوهش نشان می‌دهد اسلام ضمن استفاده از تجارب بشری غیرمغایر با موازین اسلامی، دیدگاهی فراتر از بازپروری اجتماعی دارد و با ارائه روش‌های خاصی همچون توبه‌درمانی، عفو‌درمانی، نماز‌درمانی و سایر راهبردهای اصلاحی، به اصلاح درونی و تربیت اخلاقی مجرمان توجه ویژه‌ای دارد. این رویکرد افزون بر اصلاح مجرم، زمینه بازگشت او به جامعه در جایگاه عضوی مفید را فراهم می‌آورد. بنابراین سیاست جنایی اسلام از این حیث در ابعاد مختلف دارای اهمیت و شایسته پژوهش است.

reformation and rehabilitation, defined as the set of social improvement measures undertaken for the treatment and guidance of criminals back into society, have been among the important policies discussed by criminologists over the last one or two centuries. the commitment to the reform and treatment of offenders is considered one of the hallmarks of a desirable criminal policy. from the perspective of islam, the treatment and rehabilitation of criminals is recognized as a value, and islamic texts are replete with reformatory teachings and strategies. the main question of this research is: what foundations, methods, and aims does islamic criminal policy offer for the reformation and rehabilitation of criminals?utilizing a descriptive-analytical research method and examining islamic texts, this article seeks to analyze the nature and dimensions of the rehabilitation and reformation of offenders within islamic criminal policy. the findings of the research indicate that islam, while employing compatible human experiences, holds a view that extends beyond mere social rehabilitation. by providing specific methods such as repentance therapy (tawbah-darmani), forgiveness therapy (afw-darmani), prayer therapy (namaz-darmani), and other reformatory strategies, it pays special attention to the internal reform and moral training of offenders. this approach, in addition to reforming the criminal, paves the way for their return to society as a useful member. therefore, islamic criminal policy is significant and worthy of research in various dimensions from this perspective.
