justification and explanation of the theory of marginality of the imamiyyah inherited heritage: a case study of hadith from the chapter on inheritance (al-mīrāth)

The theory attributed to ayatollah boroujerdi, which considers shiʻa jurisprudence as marginal to sunni jurisprudence, is a matter of dispute among jurists. in some interpretations, the scope of this view has extended beyond shiʻa jurisprudence and has been discussed regarding shiʻa hadith as well; meaning that shiʻa hadith is seen as marginal to sunni hadith and has been influenced by it. in this case, understanding the validity of this theory is an important issue. the present study aims to demonstrate ‘what arguments and evidence exist to support the theory of the marginality of imamiyyah hadith?’ and ‘what interpretation of it can be presented?’ clarification regarding the doubts about the impact of shiʻa hadith necessitates research on this hadith issue. the innovative approach of this research is historical phenomenology, which, according to the author, through recounting the context of the emergence of several hadiths from the chapter on inheritance in imamiyyah jurisprudence, depicts facets of the historical realities governing imamiyyah hadith and explains the validity of this theory. according to the author’s explanation, this marginality evokes the tradition of jurists annotating other viewpoints and indicates that some foundational imamiyyah hadiths emerged in response to, confrontation with, and correction of the views of the general populace.

توجیه و تقریر نظریه حاشیه بودن میراث ماثور امامیه؛ بررسی موردی احادیثی از باب المیراث

نظریه نقل شده از آیت الله بروجردی که فقه شیعه را حاشیه‌ای بر فقه اهل سنت دانسته، محل نزاع فقهاست. در برخی تقریرها، دامنه این دیدگاه از فقه شیعه فراتر رفته و درباره احادیث شیعه هم مطرح شده است؛ بدان معنا که حدیث شیعه، حاشیه‌ای بر حدیث اهل سنت است و از آن اثر پذیرفته است. در این صورت، پی بردن به درستی و موجه بودن این نظریه مساله‌ای مهم است. پژوهه حاضر بر آن است تا نشان دهد چه دلایل و شواهدی بر موجه بودن نظریه حاشیه بودن حدیث امامیه وجود دارد؟ و در این فرض، چه تقریری از آن قابل ارائه است؟ روشنگری درباره شبهه اثرپذیری حدیث شیعه از حدیث عامه، پژوهش درباره این مساله حدیثی را ضروری می‌نماید. رهیافت نوآورانه پژوهش، پدیدارشناسیِ تاریخی است که بر طبق آن نگارنده با بازگوییِ زمینه پدیداری شماری از احادیث باب المیراث امامیه، زوایایی از واقعیت‌های تاریخی حاکم بر حدیث امامیه را به تصویر کشیده و موجه بودن این نظریه را تبیین کرده است. بنا به تقریر نگارنده، کاربست تعبیر حاشیه بودن حدیث امامیه در سخن آیت الله بروجردی، تداعی‌گر سنت حاشیه‌نگاریِ فقیهان بر دیگر دیدگاه‌هاست و بیانگر آن است که شماری از احادیث تاسیسی امامیه در نظارت، رویارویی و تصحیح دیدگاه‌های عامه پدید آمده است.
