   ترنس‌ها از منظر روانشناسی و فقه امامیه

چکیده    هدف از این پژوهش، اتخاذ رویکردی یکسان در سراسر جهان اسلام و جامعه جهانی است. در این پژوهش، با استفاده از روش‌های تحلیلی و توصیفی، ضمن بیان مفاد، مبانی، اهداف و دستاوردهای تحقیق پیرامون آموزه‌های اسلامی و علم روانشناسی، مواضع فقها و روانشناسان و وجوه اشتراک و افتراق آن‌ها و نقد دیدگاه‌های موافق و مخالف تغییر جنسیت به‌طور دقیق و موشکافانه مورد بررسی قرار گرفته است. ادله ابرازی موافقان و مخالفان از جایگاه ویژه‌ای برخوردار است. در پایان، پس از بررسی و تبیین رویکرد فقهای مذاهب اسلامی و علمای علم روانشناسی نسبت به موضوع، یافته‌ها حاکی از آن است که احکام متفاوتی از ناحیه‌ی مذاهب مختلف اسلامی، از جمله جواز مطلق تا حرمت مطلق، در این خصوص شکل گرفته است. نظریه مختار نیز به این صورت است که مشروعیت تغییر جنسیت مشروط به منطبق بودن با واقعیات جامعه و ادله شرعی، علمی و عرفی است؛ این رویکرد در بسیاری از نظام‌های حقوقی و توسط حقوقدانان پذیرفته شده و دارای منفعت عقلائی و مشروع بوده و با عرف جامعه سازگار است. از این رو، جواز تغییر جنسیت تحت شرایط خاص و مشروط مورد پذیرش قرار گرفته است. نظریه‌های دیگر نیز به استدلال‌های عقلی و باورهای عرفی و کتاب و سنت که از نظر استدلالی محکمی ندارند، استناد نموده‌اند که از ناحیه شرع و علم رد شده است.

   transgender individuals from the perspective of psychology and imami jurisprudence
