الزام‌‌پذیری فقهی امور اخلاقی از حیث حکم اولی در نظام فقهی امامیه

اخلاق از مولفه‌های بسیار مهم در شکل‌دهی و انسجام فرهنگی جامعه است؛ تا آنجا که رسول اکرم (ص) از جمله رسالت‌های مهم خود را کامل نمودن مکارم اخلاق برشمرده است. در این پژوهش، با هدف دستیابی به جزء کوچکی از نظام ارزشی اخلاقی از فقه اسلامی، به بررسی امکان الزام‌پذیری امور اخلاقی، تحت ضوابط فقهی و اصولی امامیه پرداخته شد و با روش توصیفی و تحلیلی - پس از سنخ‌شناسی الزامات فقهی و اخلاقی -اتهام نسبیت‌گرایی اخلاقی به اندیشمندان مسلمان، نقد و رد شده است. در ادامه، فرایند الزام‌پذیری فقهی امور اخلاقی از حیث حکم اولی واکاوی شد و با تطبیق مسئله بر «خُلف وعده» به عنوان یک نمونه از امور اخلاقی که قابلیت پذیرش الزام فقهی را داراست؛ روشن شد که فقه امامیه این قابلیت را دارد که به برخی از امور اخلاقی الزام کند و در راستای این الزام، «نیّت» مانع نخواهد بود.  

fiqh-based obligation of moral actions in primary rulings within imami jurisprudence

ethics is a fundamental element in shaping and preserving the cultural integrity of society, as reflected in the prophet muhammad’s (pbuh) emphasis on perfecting moral virtues as a key aspect of his mission. this study explores the possibility of obligating moral actions within the framework of imami jurisprudence and principles. using a descriptive-analytical approach, the study first categorizes jurisprudential and moral obligations and refutes accusations of ethical relativism against muslim scholars. it then examines the process of fiqh-based obligation of moral actions from the perspective of primary rulings. by analyzing breach of promise as a moral action that can be subjected to jurisprudential obligation, the research demonstrates that imami jurisprudence possesses the capacity to enforce certain moral actions, with intention not constituting an obstacle to this obligation.
