چالش ها و راهکارهای تشکیل پرونده شخصیت در سیاست کیفری ایران مبتنی بر آموزه‌های جرم ‌شناسی بالینی

زمینه و هدف: تحقق سیاست کیفری موثر و متناسب با شخصیت مجرمین، یکی از اهداف اصلی نظام‌های کیفری مدرن است. در این راستا، تشکیل پرونده شخصیت در سیاست کیفری ایران از اهمیت ویژه‌ای برخوردار است، اما در مسیر اجرای آن با چالش‌های متعددی مواجه است. این مقاله به بررسی چالش‌ها و راهکارهای تشکیل پرونده شخصیت در سیاست کیفری ایران با استفاده از آموزه‌های جرم‌شناسی بالینی پرداخته است.روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است.یافته ها و نتایج: چالش‌های تقنینی این امر شامل عدم الزام قانونی برای تشکیل پرونده شخصیت، تراکم پرونده‌های کیفری و اثرات منفی آن بر تصمیم‌گیری‌های قضائی و همچنین عدم تنوع در ضمانت‌های اجرائی کیفری است. در حوزه قضائی، ضعف آموزشی و انتصاب‌های غیرعلمی کارشناسان از دیگر مشکلات برجسته هستند که به دقت و صحت تشکیل پرونده‌های شخصیت آسیب می‌زند. در بخش اجرائی نیز، کمبود منابع مالی، فقدان اماکن مناسب و متخصصین و همچنین تاکید بیش از حد بر اصل حتمیت و قطعیت مجازات‌ها، از موانع جدی به شمار می‌آید. برای ارتقای کارایی پرونده شخصیت، راهکارهایی مبتنی بر آموزه‌های جرم‌شناسی بالینی پیشنهاد می‌شود. این راهکارها شامل ارائه فعالیت‌های آموزشی و فرهنگی برای مجرمان، توسعه اشتغال و حرفه‌آموزی، فراهم‌آوری خدمات مشاوره‌ای و مددکاری اجتماعی، و آموزش کارکنان زندان‌ها است. همچنین، ارائه خدمات رفاهی به زندانیان و ایجاد شرایط مناسب آموزشی برای آن‌ها می‌تواند به کاهش جرم و بازسازی شخصیت مجرمان کمک شایانی نماید. این مقاله در نهایت پیشنهاد می‌کند که با توجه به پیچیدگی‌های روانشناختی مجرمان، به‌کارگیری روش‌های جرم‌شناسی بالینی در سیاست‌های کیفری، گامی موثر در اصلاح نظام کیفری ایران خواهد بود.

challenges and solutions for forming a personality case in iran’s criminal policy based on clinical criminology teachings

field and aims: achieving an effective criminal policy tailored to the individual characteristics of offenders is one of the primary goals of modern penal systems. in this regard, developing an offender personality file holds particular significance within iran’s criminal policy. however, the implementation of this mechanism faces numerous challenges. this article examines the challenges and proposes solutions for establishing personality profiling in iran’s criminal policy, drawing upon the teachings of clinical criminologymethod: this study was conducted using a descriptive-analytical methodfindings and conclusions: the legislative challenges in this area include the lack of legal obligation to compile personality files, the high volume of criminal cases and its negative impact on judicial decision-making, and the limited diversity in criminal enforcement measures. in the judicial domain, key issues include insufficient training and the appointment of non-expert professionals, which undermine the accuracy and reliability of personality profiling. on the executive level, serious obstacles include financial constraints, the lack of appropriate facilities and specialists, and an excessive emphasis on the principle of the certainty and severity of punishment. to enhance the effectiveness of offender personality profiling, several strategies based on clinical criminology are proposed. these include implementing educational and cultural programs for offenders, expanding employment and vocational training opportunities, providing counseling and social work services, and training prison staff. in addition, offering welfare services and appropriate educational environments for inmates can significantly contribute to crime reduction and the rehabilitation of offenders. ultimately, the article suggests that, given the psychological complexities of criminal behavior, the incorporation of clinical criminology approaches into criminal policy could serve as an effective step toward reforming iran’s penal system.
