جایگاه و تاثیر ابزارهای کیفری در گسترش و تقویت ارزش‌های دینی (مطالعه موردی حجاب)

زمینه و هدف: رعایت حجاب در جامعه ایران که جامعه‌ای مبتنی بر مکتب انسان‌ساز اسلام می‌باشد، یک ارزش دینی شناخته شده و رعایت آن از هنجارهای جامعه ایرانی اسلامی می‌باشد. مسئله‌ای که پیش می‌آید، جایگاه ابزارهای کیفری در زمینه گسترش و تقویت ارزش‌های دینی همچون عفاف و حجاب در جامعه می‌باشد. آیا می‌توان با استفاده از برخورد کیفری، رعایت یک ارزش دینی مانند رعایت عفاف و حجاب را در جامعه گسترش و تقویت کرد؟روش: پژوهش حاضر به روش توصیفی- تحلیلی می‌باشد.یافته‌ها و نتایج: رعایت ارزش‌های دینی، امری درونی و وجدانی بوده و برای گسترش و تقویت ارزش‌های دینی در جامعه، باید با تبیین جایگاه آنها، افراد خودشان به اهمیت آن موضوع پی برده و در راستای رعایت آن گام بردارند. در واقع، استفاده از ابزارهای فرهنگی برای اصلاح و تربیت انسان‌ها اولویت داشته و اثرگذاری عمیق‌تر و ماندگارتری هم خواهد داشت و استفاده از ابزار کیفری اساساً باید آخرین راهکار بوده و در موارد محدود، اجرا گردد.
