پیشگیری از پدیده کودک‌همسری از منظر آسیب اجتماعی‌شناسی (زمیولوژی) در سیاست جنایی ایران

زمینه و هدف: پدیده کودک‌همسری یکی از معضلات اجتماعی و فرهنگی است که تاثیرات عمیقی بر زندگی کودکان، به‌ویژه دختران دارد. با توجه به نوپدیدبودن دغدغه مقابله با کودک‌همسری و وارداتی‌بودن آن، نیاز است تا نگاهی ملی و مذهبی به این موضوع شود تا الگوی درست برای سیاست جنایی ایران در این رابطه ارائه گردد. این پژوهش به ارائه راهکارهای پیشگیری کیفری و غیرکیفری از پدیده کودک‌همسری از دیدگاه آسیب اجتماعی‌شناسی (زمیولوژی) در سیاست جنایی ایران پرداخته است.روش: پژوهش حاضر به روش توصیفی و تحلیلی انجام شده است.یافته‌ها و نتایج: به منظور پیشگیری از این پدیده، جرم‌انگاری افتراقی ازدواج پیش از بلوغ، جرم‌انگاری ازدواج اجباری و جرم‌انگاری امتناع از ثبت‌نام و فراهم‌کردن موجبات تحصیل طفل و نوجوان مهم­ترین راهکارهای پیشگیری کیفری از کودک‌همسری است. یکنواخت‌سازی سن مجاز ازدواج به 18 سال شمسی و اصلاح قوانین و تصویب طرح کودک‌همسری مهمترین راهکارهای پیشگیری وضعی از کودک‌همسری تلقی می­شود و اصلاح و تعدیل تفکر مردسالاری و برگزاری سمینارهای حقوق کودک مهم­ترین راهکارهای پیشگیری اجتماعی از کودک‌همسری در نظر گرفته شده است و آموزش و آگهی‌بخشی در راستای پیشگیری خانواده‌محور و آموزش و آگهی‌بخشی در راستای پیشگیری مدرسه‌محور مهم­ترین راهکارهای پیشگیری رشدمدار از کودک‌همسری اختصاص پیدا کرده است. این پژوهش تاکید می‌کند که مقابله با کودک‌همسری نیازمند یک رویکرد جامع و چندبُعدی است که مستلزم همکاری همه‌جانبه نهادهای دولتی و غیردولتی، جامعه مدنی و رسانه‌ها می‌باشد. اجرای این راهکارها می‌تواند به کاهش شیوع کودک‌همسری و بهبود وضعیت کودکان کمک کند.

prevention of the phenomenon of child marriage from the point of view of sociological damage (zemiology) in iran’s criminal policy

field and aims: the phenomenon of child marriage is one of the social and cultural problems that has a deep impact on the lives of children, especially girls. considering the recent emergence of the concern of dealing with child marriage and its imported nature, it is necessary to look at this issue with a national and religious perspective in order to provide the right model for iran’s criminal policy in this regard. the phenomenon of child marriage has been studied from the point of view of sociological harm in iran’s criminal policy.method: the present research was carried out using a descriptive and analytical method.findings and conclusions: in order to prevent this phenomenon, differential criminalization of pre-pubescent marriage, criminalization of forced marriage, and criminalization of refusal to register and providing opportunities for child and adolescent education are the most important ways to prevent child marriage. unifying the legal age of marriage to 18 years and amending the laws and approving the plan of child marriage are considered the most important ways to prevent child marriage, and modifying and adjusting patriarchal thinking and holding seminars on children’s rights are considered the most important social prevention methods of child marriage. it has been taken and part of education and advertisement for family-oriented prevention and part of education and advertisement for school-oriented prevention of the most important methods of growth-oriented prevention of child marriage have been dedicated. this research emphasizes that dealing with child marriage requires a comprehensive and multidimensional approach that requires the comprehensive cooperation of governmental and non-governmental institutions, civil society, and the media. the implementation of these solutions can help reduce the prevalence of child marriage and improve the condition of children.
