استراتژی‌های پیشگیری از ارجاع پرونده‌های حقوقی در حوزه ورزش عمومی با رویکرد مسئولیت مدنی در محاکم قضایی ایران

در سال‌های اخیر، شواهد پژوهشی حاکی از افزایش ارجاع پرونده‌های حوادث ورزشی به محاکم قضایی است. هدف از این تحقیق تدوین استراتژی‌های پیشگیری از ارجاع پرونده‌های حقوقی در حوزه ورزش عمومی با رویکرد مسئولیت مدنی در محاکم قضایی ایران بود. روش تحقیق از نظر هدف کاربردی و از نظر داده ها کیفی (از نوع تحلیل مضمون) بود. مشارکت کنندگان در تحقیق شامل8 نفر از کارشناسان رسمی دادگستری در امور ورزشی، 5 نفر از مدیران ورزشی و 3 نفر از اساتید مدیریت ورزشی و 5 نفر از قضاتی که در حوزه حقوق ورزشی تخصص داشتند، بودند. ابزار گردآوری اطلاعات مصاحبه های نیمه ساختاریافته عمیق بود. تعامل و مشارکت با مشارکت کنندگان، همسوسازی ، بهره مندی از دوستان منتقد و توصیف عمیق فرایند تحقیق مهم ترین راهبردهای اعتباربخشی به فرایند تحقیق بود. این پژوهش نشان داد که پیشگیری از ارجاع پرونده‌های حقوقی مسئولیت مدنی در حوزه ورزش عمومی به محاکم قضایی نیازمند اتخاذ رویکردی چندوجهی است که شامل 1- تقویت نظام حقوقی و قانونی جهت توسعه ساختارهای نظارتی و انضباطی 2- ارتقای فرهنگ حقوقی و اخلاقی در راستای اشاعه و ترویج آموزه های مرتبط در افراد 3- حمایت‌های مالی و بیمه‌ای از ورزشکاران و مدیران، 4- ارائه خدمات حمایتی و مشاوره‌ای تحت نظارت سازمان های مرتبط، و 5- به‌کارگیری فناوری و نوآوری جهت فرایندهای نظارتی می‌باشد.

strategies for preventing the referral of legal cases in the public sports sector through the civil liability approach in iran’s judicial courts

recent research has shown an increase in the referral of sports accident cases to the courts in recent years. the purpose of this study was to develop strategies for preventing the referral of legal cases in the public sports sector through the civil liability approach in iran’s judicial courts. the research method was applied in terms of purpose and qualitative in terms of data (thematic analysis type). the research participants included 8 official judicial experts in sports affairs, 5 sports managers, 3 sports management professors, and 5 judges who specialized in the field of sports law. the data collection tool was in-depth semi-structured interviews. interaction and participation with participants, triangulation, utilizing critical friends, and thick description of the research process were the most important strategies for validating the research process. this research showed that preventing the referral of civil liability cases in the field of public sport to the courts requires adopting a multifaceted approach that includes 1- strengthening the legal and regulatory system to develop supervisory and disciplinary structures, 2- promoting legal and ethical culture in order to disseminate and promote relevant teachings among individuals, 3- financial and insurance support for athletes and managers, 4- providing support and consulting services under the supervision of relevant organizations, and 5- applying technology and innovation for supervisory processes.
