بررسی اختلافات تفسیری فریقین در باره آیات تشریعی حوزه نکاح

با توجه به اختلافات تفسیری که در حوزه آیات الاحکام نکاح در دیدگاه فریقین وجود دارد، مقاله‏ی پیش رو بر اساس پرسش پیرامون مصادیق اختلافات تفسیری در حوزه‏ی مذکور با رویکرد تطبیقی سامان یافته است. آیات الاحکام نکاح حول محورهای مشروعیت، محرمات و لوازم و توابع آن احصاء می‏شوند و در هر یک از محورها و موضوعات مذکور، اختلافات متعددی نیز قابل دستیابی است. این پژوهش مبتنی بر روش توصیفی- تحلیلی بوده و گردآوری اطلاعات، بر اساس روش کتابخانه‏ای صورت گرفته است. یافته‏های پژوهش نشان می‏دهد که در بحث مشروعیت، فریقین در جواز ازدواج موقت اختلاف دارند، به طوری که امامیه قائل به جواز و معظم اهل سنت قائل به عدم جواز آن می‏باشند. در محرمات نکاح، دیدگاه‏های مربوط به ایجاد رحم از طریق وطی نامشروع و ازدواج با زنان اهل کتاب متفاوت است و در لوازم و توابع نکاح، مباحث مهریه و مقدار آن، پرداخت متاع و نفقه و همچنین موضوع نگاه، خصوصاً نگاه به مخطوبه و برخی از احکام وطی، اختلافی است.

examining the interpretive differences between shiites and sunnis about the legislative verses on marriage

considering the interpretive differences that exist about the verses of the rules of marriage in the view of shiite and sunni commentators, the present article is based on the question about the examples of interpretive differences about marriage with a comparative approach. the &verses of the rules of marriage& have discussed the legitimacy, prohibitions and requirements of marriage, and in each of these issues, there are several differences. this research is based on descriptive method and data collection is based on library method. the findings of this study show that in the discussion of legitimacy, shiite and sunni commentators differ in the permission of temporary marriage, so that shiite commentators believe in the permission and most sunnis believe in the impermissibility of temporary marriage. in the prohibitions of marriage, views on the creation of the womb through illicit intercourse and marriage with women of the book differ. there is a difference in the supplies and functions of marriage, the issues of dowry and its amount, the payment of expenses and alimony, as well as the issue of looking, especially looking at a girl with whom he intends to marry, and some of the rules of intercourse.
