جواز آمیزش نامتعارف؛ خوانشی انتقادی

حد متیقن از جواز تمتعات جنسی به‌موجب عقد نکاح، استمتاع و آمیزش متعارف است، لکن در برخی رویکردها حکم به جواز آمیزش مقعدی شده است؛ درحالی‌که قاعده حرمت ایذاء همسر، معاشرت به معروف و روایات ناظر به آداب خلوت میان زوجین، همگی بر رفتار جنسی کرامت‌مدار اشعار دارند و جواز رفتارهای نامتعارف جنسی را ولو با رضایت همسر با تردید مواجه می‌سازند؛ چراکه به دلیل فرادستی غالب مردان، رضایت زوجه در اکثر موارد باطنی نمی‌باشد. افزون بر آن‌که مطابق اعتقاد امامیه به دلیل ابتنای احکام بر مصالح و مفاسد نفس‌الامری و قطعی بودن عوارض وطی از دُبُر، جواز این رابطه مورد تردید قرار‌می‌گیرد. ازاین‌رو با وجود برخی تعابیر در متون فقهی که انگارۀ تمکینِ مطلق را فارغ از هرگونه محدودیتی به ذهن متبادر می‌کند، فروضی که احتمال آسیب زوجه در آن رابطه وجود دارد، تحریم و تقبیح شده است. این جستار به روش توصیفی تحلیلی با بهره‌گیری از روش مطالعه کتابخانه‌ای انجام شده و ضمن بررسی و تحلیل ادله مورد استناد درخصوص جواز وطی از دُبُر با اشاره به تشتّت آرا پیرامون تفسیر ادله نقلی، معتقد است که استمداد از رویکرد مقاصدی می‌تواند به خوانشی نوین از متون، در پرتو ارزش‌های بنیادینی که نص بر آن‌ها استوار است، بینجامد.

permissibility of unconventional intercourse; a critical reading

the definite limit of permissibility of sexual enjoyment according to the marriage contract is conventional enjoyment and intercourse, but in some approaches, it has been ruled that anal intercourse is permissible; while the rule of being forbidden for harming one’s wife, behaving in honorable manner and the narrations regarding the norms between spouses, all of them have respect for moral sexual behavior and cast doubt on the permissibility of unconventional sexual behavior even with the wife’s consent; because due to the dominance of most of men, the wife’s satisfaction in most cases is not internal. in addition, according to the belief of the imamiyyah, the permissibility of this relationship is doubted due to the fact that the rulings are based on the factual and definite benefits and corruptions consequences of anal intercourse. this study, using a descriptive-analytical method, by using the library study method, examines and analyzes the evidences cited regarding the permissibility of anal intercourse, while pointing out the diversity of opinions about the interpretation of the narrative reasons, believes that using the purposeful approach can lead to a new reading of texts according to the fundamental values on which the text is based.
