تحلیل فقهی پدیده عقد ازدواج آریایی در ایران معاصر؛ مبانی و چالش‌ها

با ظهور و گسترش دین اسلام در ایران، بسیاری از آداب‌ورسوم و سنت‌های ایران باستان نیز دستخوش تغییر و تحوّل شد و پیروی از سنت پیامبر اکرم (صلی الله علیه و آله) به‌عنوان الگوی حسنه، در امور بسیاری ازجمله عقد نکاح جایگزین سنت پیشینیان شد؛ بااین‌حال در سال‌های اخیر، بسیاری از جوانان ایرانی با هدف بازگشت به سنت‌های پیشینیان، درصدد جایگزینی عقد نکاح آریایی با اتکا به سنت‌های باستانی ایرانی خارج از چارچوب‌های شرعی و قانونی متداول به‌جای عقد ازدواج اسلامی هستند که این امر به‌نوبه خود، چالش‌هایی را در حوزه مشروعیت، آثار حقوقی و تبعات اجتماعی به عنوان یکی از پدیده‌های نوظهور در عرصه مناسبات اجتماعی به دنبال دارد. در این پژوهش که به روش توصیفی تحلیلی انجام گرفته، این نتایج حاصل شده است که: گرایش به خواندن عقد ازدواج آریایی به‌جای عقد نکاح اسلامی، علاوه بر این‌که از نظر صحّتِ عقد ازدواج با اشکال مواجه است و منجر به ابهام در تعیین حدود تکالیف و حقوق زوجین می‌گردد، با چالش‌های دیگری نیز ازجمله تقلید کورکورانه از سنت پیشینیان، وهن احکام اسلامی و بدعت در دین، تمایل به گرایش‌های نژادپرستانه و کم‌رنگ شدن اهمیت جامعیت دین اسلام و لزوم پیروی از سنت پیامبر (صلی الله علیه و آله) به‌عنوان الگوی حسنه در جامعه نیز همراه است که درنهایت درگذر زمان، به یک چالش فرهنگی مذهبی تبدیل خواهد شد. در پژوهش حاضر، با بررسی دیدگاه‌های فقهی و حقوقی موجود، راهکارهایی برای رفع موانع شرعی و قانونی این نوع ازدواج ارائه شده است.

a jurisprudential study of the phenomenon of aryan marriage in contemporary iran; fundamentals and challenges

with the emergence and spread of islam in iran, many of the ancient persian customs and traditions underwent significant changes. following the traditions of the prophet muhammad (pbuh) as a noble example gradually replaced pre-islamic practices in many areas, including the institution of marriage. however, in recent years, a growing number of iranian youth, seeking a return to their ancestral traditions, have attempted to replace the islamic marriage contract (nikah) with the so-called arian marriage contract, based on ancient iranian customs—outside the conventional religious and legal frameworks. this phenomenon has, in turn, raised various challenges in terms of legitimacy, legal consequences, and social implications, making it one of the emerging issues in contemporary social relations. this study, conducted using a descriptive-analytical method, concludes that the tendency to perform the arian marriage contract instead of the islamic nikah is problematic not only due to concerns regarding the legal validity of the marriage and ambiguities in determining the rights and obligations of the spouses, but also because it involves several other issues. these include blind imitation of ancestral traditions, undermining islamic rulings, introducing religious innovations (bid‘ah) , inclinations toward racial superiority, and diminishing the significance of the comprehensive nature of islam and the necessity of following the prophet’s example as a model for society. over time, this trend is likely to evolve into a cultural-religious challenge. the present study examines existing jurisprudential and legal perspectives and offers solutions to address the religious and legal obstacles related to this type of marriage.
