ساختار فقه فرهنگ

فقه فرهنگ به‌عنوان یکی از چهار عرصه کلان فقه در کنار فقه اجتماعی، فقه سیاسی و فقه اقتصادی، به بررسی تعامل میان احکام شرعی و پدیده‌های فرهنگی می‌پردازد. این حوزه با بهره‌گیری از اصول اجتهاد، در تلاش است تا چارچوبی نظام‌مند برای تحلیل و تنظیم مناسبات فرهنگی ارائه دهد. تاکنون ساختار فقه فرهنگ کمتر مورد بررسی قرار گرفته است. این مقاله با روش توصیفی و تحلیلی ساختار فقه فرهنگ را موردمطالعه قرار می‌دهد و پیشنهاد ساختاری برای فرهنگ و زیرشاخه‌های آن دارد. ازنظر نویسنده، فقه فرهنگ دارای چهار بخش مبادی فقه فرهنگ، کلیات، قواعد فقه فرهنگ و مسائل فقه فرهنگ است و مسائل فقه فرهنگ شامل شش عنوان باورها، ارزش‌ها، گرایش‌ها، رفتارها، نمادها و فنّاوری می‌باشد. فقه فرهنگ دست‌کم دارای پنج زیرشاخه با عناوین فقه هنر، فقه ارتباطات، فقه رسانه، فقه فضای مجازی و فقه سبک زندگی است. هر یک از این فقه‌ها نیز می‌توانند زیرشاخه‌های جزئی‌تری داشته باشند. این پژوهش بر آن است تا با بررسی دقیق ساختار فقه فرهنگ، نقش آن را در هدایت تحولات اجتماعی و فرهنگی تبیین کند و ظرفیت‌های آن را برای پاسخ‌گویی به نیازهای جوامع اسلامی برجسته سازد.

jurisprudence of culture, as one of the four major areas of jurisprudence, along with social jurisprudence, political jurisprudence, and economic jurisprudence, studies the interaction between religious rulings and cultural phenomena. this field, using the principles of ijtihad, is trying to provide a systematic framework for analyzing and regulating cultural relations. it is jurisprudence of culture. so far, the structure of jurisprudence of culture has been less studied. this article studies the structure of jurisprudence of culture with a descriptive and analytical method and proposes a structure for culture and its sub-branches. in the author’s opinion, jurisprudence of culture has four sections: principles of jurisprudence of culture, generalities, rules of jurisprudence of culture, and issues of jurisprudence of culture, and the issues of jurisprudence of culture include six headings: beliefs, values, tendencies, behaviors, symbols, and technology. jurisprudence of culture has at least five sub-branches with the titles of jurisprudence of art, jurisprudence of communications, jurisprudence of media, jurisprudence of space, and jurisprudence of lifestyle. each of these jurisprudences can also have more detailed sub-branches. this research aims to explain its role in guiding social and cultural developments and highlight its capacities to respond to the needs of islamic societies by carefully examining the structures of the jurisprudence of culture.
