تضاد یا تعامل بین حقوق عامه و حقوق شهروندی؛ چالش‌ها و راهکارها

یکی از چالش‌های اساسی در نظام‌های حقوقی، ایجاد تعادل میان حقوق عامه و حقوق شهروندی است. حقوق عامه که تامین منافع عمومی، امنیت و نظم اجتماعی را هدف قرار می‌دهد، گاه ممکن است با حقوق شهروندی که بر آزادی‌های فردی و کرامت انسانی تاکید دارد، در تضاد قرار گیرد. این تضادها به‌ویژه در مواردی نظیر محدودیت‌های امنیتی، نظارت بر فضای مجازی و سیاست‌های اجتماعی نمود پیدا می‌کنند. این پژوهش با استفاده از روش تحلیلی به بررسی مبانی نظری و مصادیق تقابل و هم‌گرایی میان این دو دسته حقوق پرداخته است. داده‌ها از منابع معتبر فقهی و حقوقی گردآوری و تحلیل‌ها بر اساس چارچوب‌های نظری و مطالعات تطبیقی انجام شده است. یافته‌های پژوهش نشان می‌دهد که در حوزه‌هایی مانند بهداشت عمومی و عدالت اجتماعی، هم‌افزایی میان حقوق عامه و حقوق شهروندی امکان‌پذیر است. درنهایت، راهکارهایی نظیر تدوین قوانین شفاف، نظارت قضائی موثر و ایجاد توازن میان امنیت و آزادی پیشنهاد شده است. این تحقیق می‌تواند به سیاست‌گذاران و قانون‌گذاران در ایجاد تعادل پایدار میان حقوق فردی و عمومی کمک کند.

assessing the conflict and interaction between public rights and citizenship rights; analyzing challenges and practical solutions

one of the fundamental challenges in legal systems is achieving a balance between public rights and citizenship rights. public rights, which aim to ensure public interests, security, and social order, may sometimes conflict with citizenship rights that emphasize individual freedoms and human dignity. these conflicts are particularly evident in cases such as security restrictions, government surveillance of cyberspace, and social policy measures. this research adopts an analytical approach to examine the theoretical foundations and examples of conflict and convergence between these two categories of rights. data were gathered from credible legal sources, and analyses were conducted based on theoretical frameworks and comparative studies. the findings indicate that in areas such as public health and social justice, synergy between public rights and citizenship rights is achievable. ultimately, solutions such as drafting clear legislation, effective judicial oversight, and establishing a balance between security and freedom are proposed. this study can assist policymakers and legislators in creating a sustainable equilibrium between individual and public right.
