فضیلت قضایی دادرسان از منظر فرهنگ نحله‌های حقوقی

فضیلت‌های قضایی دادرسان، به عنوان یکی از ارکان اساسی در نظام‌های حقوقی، نقش بسزایی در تضمین عدالت و اجرای صحیح قوانین دارند. این پژوهش با هدف بررسی مفهوم و ابعاد فضیلت قضایی دادرسان از منظر فرهنگ نحله‌های حقوقی مختلف، به تحلیل ویژگی‌ها و رفتارهای دادرسان در راستای تحقق عدالت می‌پردازد. با توجه به تنوع فرهنگی و حقوقی در نحله‌های مختلف، این مقاله تلاش می‌کند تا تفاوت‌های رویکردها و تاثیرات آن‌ها بر کیفیت دادرسی و ارزیابی فضیلت‌های قضایی را مورد بررسی قرار دهد. همچنین، اهمیت و تاثیر فضیلت‌های اخلاقی و حرفه‌ای دادرسان در ارتقاء اعتماد عمومی به نهاد قضایی و تاثیر آن بر نتیجه‌گیری‌های قضائی مورد توجه قرار می‌گیرد. نتایج تحقیق نشان می‌دهد که فرهنگ‌های حقوقی مختلف، با توجه به نگرش‌های فلسفی و اخلاقی خاص خود، تعریف و اولویت‌های متفاوتی در خصوص فضیلت‌های قضایی دادرسان دارند، اما در نهایت همه آن‌ها بر اهمیت رعایت انصاف در دادرسی همراه با اخلاص در عمل و تهذیب نفس خوش‌رفتاری و برخورد نیکو، رعایت مساوات و عدالت در دادگری و اجرای حکم مسئولیت‌پذیری و پاسخ‌گویی نسبت به صاحبان حق قاطعیت در قضاوت و برخورد با خاطیان آگاهی تاکید دارند.

judicial virtue of judges from the perspective of legal school cultures

the implementation of fair trials is one of the fundamental principles of an islamic society. considering the vital role of just adjudication in achieving the islamic-iranian model of development, this study examines the foundations of judicial virtue from the perspective of different legal schools of thought.the judicial framework in an islamic society is structured to ensure that people’s lives, property, and honor are not placed in the hands of unworthy individuals, and that individual and societal rights are not sacrificed for personal biases or the agendas of self-serving and deviant groups. the findings of this research indicate that the key characteristics of judicial virtue can be derived from the holy quran and the life of the infallibles. these characteristics include fairness in adjudication, sincerity in action and self-discipline, good conduct and respectful treatment of others, upholding equality and justice in judgment and enforcement of rulings, responsibility and accountability towards rightful claimants, and firmness in judgment and dealing with offenders.
