فلسفه جهانی شدن و تاثیر آن در شکل‌گیری قواعد و نهادهای بین‌‌المللی

وجود سرنوشت مشترک برای بشر و به‌تبع آن ایجاد پیوندهای بیشتر در جهت رفع چالش‌‌های مشترک، که برای اولین بار در منشور ملل متحد مورد توجه قرار گرفت، برای رسیدن به اهداف مشترکی چون آزادی، عدالت و برابری، افکار بشریت را به سوی جهانی شدن هدایت می‌‌کند. در این راستا، تحقیق حاضر به بررسی امکان و روند جهانی شدن حقوق پرداخته و ضمن بررسی دیدگاه‌ها و نظریه‌های مختلف پیرامون جهانی شدن، روند جهانی شدن حقوق را دنبال می‌نماید. روش پژوهش توصیفی- تحلیلی بوده و نتایج حاکی از آن است که جهانی شدن حقوق به عنوان بخش خاصی از جهانی شدن، به فرایندی اطلاق می‌شود که به همسان‌سازی و یکسان‌سازی مفاهیم، قواعد و نهادهای حقوقی خاصی در سطح داخلی و بین‌المللی می‌انجامد. امروزه بیشتر نظریه‌پردازان این حوزه هم‌نظرند که جهانی شدن بخشی از یک فرآیند بسیار طولانی‌تر یکپارچگی اجتماعی است. در میان نظریه‌پردازان جهانی شدن، نظریات والراشتاین، آنتونی گیدنز، مانوئل کاستلز، دیوید هلد و آنتونی مک گرو، پل هرست و گراهام تامپسون، جوزف استیگلیتز از همه برجسته‌تر است. ازجمله نمودهای جهانی شدن در حقوق بین‌الملل معاصر شامل تعهدات عام الشمول، مداخلات بشردوستانه و شرکت‌های فراملی هستند.

the philosophy of globalization and its impacton the formation of international rules and institutions

the existence of a shared destiny for humanity and, consequently, the creation of greater interconnectedness to address common challenges – which was first considered in the charter of the united nations – vividly directs human thought towards globalization in order to achieve common goals such as freedom, justice, and equality. in this regard, the current research examines the possibility and process of the globalization of law. while reviewing wide different viewpoints and theories on globalization, it follows the trend of the globalization of law. the research method hired here, is descriptive-analytical, and the results indicate that the globalization of law, as a specific part of globalization, refers to a process that leads to the harmonization and standardization of specific legal concepts, rules, and institutions at the domestic and international levels. nowadays, most theorists in this field highly agree that globalization is part of a much longer process of social integration. among globalization theorists, the theories of wallerstein, anthony giddens, manuel castells, david held and anthony mcgrew, paul hirst and grahame thompson, and joseph stiglitz are the most prominent. examples of globalization in contemporary international law include erga omnes obligations, humanitarian interventions, and transnational corporations.
