بررسی چالش ها و موانع نهاد تنظیم گری استارت آپ ها در نظام حقوقی ایران

در دورانی که دولت‎ها تنها فعالان حوزه اداره عمومی محسوب نمی‎شوند، تنظیم‎ گری به عنوان یکی از مهم ‎ترین کارکردهای حکمرانی جدید مطرح می‎شود. به همین دلیل بسیاری از کشورها به تاسیس نهادهای تنظیم‎ گر به خصوص تنظیم ‎گری اقتصادی روی آورده‎اند. هدف از انجام این تحقیق، بررسی چالش ها و موانع نهاد تنظیم گری استارت آپ ها در نظام حقوقی ایران می باشد. این تحقیق دارای ماهیت کاربردی بوده و قصد بر ارائه توضیح و تفسیر از کلیات اقدامات قانونگذاری استارت آپ ها در کشور دارد. هر چقدر صاحبان کسب‏وکارهای نو با قوانین آشنا شوند بهتر می‏توانند مشکلات خود را حل و فصل کنند و مهم‏تر اینکه دانستن قوانین می‏تواند به ادامه و بقای حیات کسب‏وکارها کمک تعیین کننده‏ای داشته باشد. با توجه به موضوع مورد بحث مسئله اساسی در تامین مالی این شرکتها می باشد که نیازمند چارچوب قانونی برای مدیریت آن است. در کشور با توجه به تلاش دولت برای توسعه اقتصاد کارآفرینان و دانش بنیان، نیاز به رشد و توسعه استارت آپ ها برای افزایش کارآیی و بهره وری اهمیت تامین مالی روز به روز افزایش می یابد که آن نیاز برای توجه به مسئله تامین مالی با توجه به نظام حقوقی برای پوشش کاستی سرمایه استارت آپ ها را طلب می کند.

examining the challenges and obstacles of startup regulatory institutions in iran’s legal system

in an era when governments are not considered the only actors in the field of public administration, regulation is considered as one of the most important functions of new governance. for this reason, many countries have turned to establishing regulatory institutions, especially economic regulation. the purpose of this research is to examine the challenges and obstacles of startup regulatory institutions in iran’s legal system. this research has an applied nature and aims to provide an explanation and interpretation of the general legislative actions of startups in the country. the newer business owners get to know the rules, the better they can solve their problems, and more importantly, knowing the rules can be a decisive help in the survival of businesses. according to the topic under discussion, the basic issue is in the financing of these companies, which requires a legal framework for its management. in the country, due to the efforts of the government to develop the economy of entrepreneurs and knowledge-based, the need for the growth and development of start-ups to increase the efficiency and productivity, the importance of financing is increasing day by day, which is the need to pay attention to the issue according to the legal system, financing is required to cover the deficiency of start-up capital.
