تحلیل اجتماعی ملاک در حدود حق مواقعه زوجه از منظر فقه امامیه

فقها در حدود حق جنسی زوجه اختلاف نظرهایی دارند. گروهی وجوب مواقعه هر چهارماه یکبار را بر زوج پذیرفته و برخی به حکم اولی عدم تحدید قائل شده اند. گروهی نیز رفع تحدید زمانی را در شرایطی به حکم ثانوی مطرح کرده اند. در عصر کنونی که از یک طرف تعدد و تنوع محرکات جنسی و افزایش حضور اجتماعی زنان چشمگیر و از طرف دیگر پیامدهای بی توجهی به نیاز جنسی، غیر قابل انکار است، دست یافتن به ملاک ادله ای که ناظر بر تعیین حدود حق مواقعه زوجه است و تحلیل آن، امکان تحدید زمانی یا عدم آن را در محل بحث روشن می کند. از همین روی در پژوهش حاضر به روش تحلیل محتوا ملاک ادله مرتبط با حدود حق مواقعه زوجه از طریق سنجه های فهم ملاک در فقه، کشف و تحلیل فقهی – اجتماعی شد. با توجه به قاعده معاشرت به معروف، مقاصد ازدواج، روایت نهی از مضاره و با نظر به داده های بیرونی نیاز متعارف زوجه به عنوان ملاک در حدود حق مواقعه او کشف و امکان تحدید زمانی منتفی گردید.

the legal perspective on the limits of a wife's sexual rights has significant differences among scholars. some accept the obligation of sexual relations every four months for the husband, while others argue against any limitation by default. a group also suggests that conditional secondary rulings can lift time constraints in specific scenarios. in today's era, where there is a noticeable increase in sexual stimuli and women's social presence on one hand, and undeniable consequences of neglecting sexual needs on the other, it becomes crucial to reach valid criteria from the evidences concerning the boundaries of a wife’s sexual rights and analyze them. this exploration will clarify whether there should be a time limitation or not. therefore, in this research, employing content analysis, the criteria related to the limits of a wife's sexual rights were extracted and analyzed through the lens of legal understanding in islamic jurisprudence. considering the principle of appropriate coexistence, the objectives of marriage, and the narration prohibiting harm, alongside external data about the wife's typical needs, serves as the basis for determining her sexual rights, leading to the conclusion that imposing time limits is unfounded.
