قاچاق بخشی از اقتصاد غیررسمی است که در آمارهای رسمی ثبت نمی‌شود.امروزه، قاچاق جرمی عرضی است و جرم انگاری آن سابقه چندانی ندارد. ولی از حیث سابقه قانون‌گذاری آن عمری به درازای عمر قانون‌گذاری ایران دارد. قاچاق، پدیده شوم و مخربی است که صدمات فراوانی بر پیکر اقتصاد ملی کشور وارد کرده و فعالیت اقتصاد رسمی، برنامه‏ها و سیاست‌های کشور ما را تحت‏الشعاع قرار داده و دچار اختلال نموده است. قاچاق معضلی است که خسارت‌های اقتصادی و فرهنگی گسترده‌ای به کشور وارد کرده و ملتی را از درآمدهای مشروع و قانونی چشمگیر محروم ساخته است. برای حمایت از اقتصاد کشور، شناسایی ماهیت مجرمانه پدیده قاچاق، تحلیل بسترها و زمینه‌های گسترش فعل یادشده تبیین راهکارهای پیشگیری این عمل مجرمانه همواره موردتوجه بوده است. منابع مورداستفاده این تحقیق نیز به روش کتابخانه‏ای و اسنادی گردآوری‌شده است.

smuggling is part of an informal economy that is not recorded in official statistics. today, smuggling is a transverse crime, and its criminalization has little precedent. but due to its legislative history, it has a long life span in iran. smuggling is a fatal and destructive phenomenon that has inflicted great damage on the nation s national economy and has undermined the activities of the official economy, policies of our country. smuggling is a problem that has brought enormous economic and cultural losses to the country and deprives a nation of significant legal and legitimate revenues. in order to support the country s economy, identifying the criminal nature of the smuggling phenomenon, analyzing the grounds and areas for expanding the doing, the explanation of the ways of preventing this criminal act has always been taken into consideration. the sources used in this research are gathered in a library and documentary way.
