جایگاه و اعتبار قرارداد هوشمند بلاک چین از منظرحقوق قراردادی ایران

فناوری نوپایِ بلاک چین اخیرا به کمک قرارداد هوشمند آمده تا با بهره گیری از ماهیت غیر متمرکز خود اجرای بی طرفانه ی توافق طرفین را تضمین کند. هرچند هنوز بستر های لازم برای استفاده گسترده از این قراردادها در زندگی بشر فراهم نشده است اما تجربه نشان داده که فناوری های نوین، خیلی زود راه خود را به زندگی عموم باز می کنند. بنابراین لازم است تا حقوقدانان هرچه سریعتر با شناخت از ماهیت فنی و پیچیده این قسم از قراردادها، به جامعه ی خواهانِ استفاده از فناوری های نوین پاسخ دهند: آیا به لحاظ حقوقی قرارداد هوشمند دارای یک ماهیت قراردادی است؟ در صورتی که پاسخ مثبت است آیا مطابق قواعد عمومی حاکم بر معاملات می توان حکم به اعتبار این قراردادها داد؟ در این پژوهش در یک دسته بندی نوآورانه، بدواً قراردادهای هوشمند از جنبه قدرت اجرایی به سه دسته ضعیف، متوسط و قوی تقسیم شده اند. آنچه در این دسته بندی مورد توجه قرارگرفته است قدرت قرارداد های هوشمند در اجرای مفاد قرارداد می باشد و هدف از آن، تبیین جایگاه قرارداد هوشمند بلاک چین در میان سایر قراردادهای هوشمند می باشد. سپس با واکاویِ ماهیت فنیِ قرارداد هوشمند بلاک چین، دو فناوری پشتیبان آن (مجری هوشمند و بلاک چین) مورد تدقیق قرار گرفته است. در نهایت اعتبار قرارداد هوشمند از منظر حقوق قراردادی ایران به اثبات رسیده است. بدین منظور بدواً نحوه شکل گیری تراضی در قرارداد هوشمند بلاک چین مورد ارزیابی قرار گرفته است. سپس از طریق تطبیق نحوه تشکیل قرارداد هوشمند بلاک چین با قواعد عمومی معاملات، اعتبار تراضی طرفین در قرارداد هوشمند بلاک چین به اثبات رسیده است

positon and validity of blockchain smart contract from the perspective iranian contractual law

emerging blockchain technology has recently come to the aid of smart contracts to ensure the impartiality of the parties agreement, using its decentralized nature. although required fields for the widespread use of smart contract in human life have not yet been provided, experience has shown that new technologies are opening their way to public life very soon. therefore, it is necessary for jurists by aware of the complex and technical nature of smart contracts to respond as quickly as possible to the society seeking to use the new technologies: is smart contract a real contract? if the answer is yes, can be valid in accordance with the general rules governing contracts? in this research, in an innovative classification, smart contracts are divided into three categories: weak, moderate and strong. what is considered in this category is the power of smart contracts in executing the terms of the contract and its purpose is to clarify the position of blockchain smart contract among other smart contracts. then, by examining the technical nature of the blockchain smart contract, two of its backup technologies (smart executor and blockchain) are outlined. finally, the validity of smart contract blockchain from perspective of iranian contractual law has been proven. for this purpose, firstly, how the formation of agreement in the blockchain smart contract has been evaluated. then, by comparing formation of blockchain smart contract with the general rules of trading, the validity of blockchain smart contract is proven.
