حاکمیت حل اختلاف بلاکچین

چکیده؛ فن‌آوری بلاکچین به عنوان زیر ساختی برای خوداجرایی قرارداد‌های هوشمند عمل می‌کند. از آنجا که قرارداد‌ها ناقص هستند و بعضی از طرفین فرصت طلب هستند، این گزینه‌های قراردادی جدید، چالش‌هایی در زمینه حل اختلافات ایجاد نموده اند. برای مثال آیا قرارداد‌های هوشمند به رسمیت شناخته خواهند شد و هرگونه اختلاف (دراین زمینه) در دادگاه‌های موجود در حوزه‌های قضایی حل خواهد شد؟ در این مقاله نخست ما برخی گزینه‌های حاکمیت سازمانی (برای مثال میانجیگری، داوری خصوصی، دادگاه‌ها) را جهت ایجاد یک حد و مرز امکان (گزینه) حل اختلاف برای طرفین ترسیم می کنیم. دوم، ما مطالعات موردی ساز و کار‌‌های مبتنی بر بلاکچین در حال ظهور را برای حل چالش‌های حل و فصل اختلاف ارائه می دهیم. قرارداد‌های هوشمند مبتنی بر بلاکچین نه تنها ممکن است مشکلات حل اختلاف ایجاد کند، بلکه همچنین به عنوان یک فن‌آوری برای کار آفرینان برای ایجاد ساز و کار‌‌های جدیدی جهت حل مشکلات اختلافی از جمله آنچه از قرارداد‌های حقوقی سنتی ناشی می‌شود عمل می‌کنند. طرف‌های قرارداد، ذاتا موثرترین ساز و کار حاکمیتی خود را برای حل اختلافات بر می گزینند و هزینه‌های حل منازعات را در طول زمان از طریق یک روند نوآوری نهادی تغییر خواهند داد.

the governance of blockchain dispute resolution

abstract: blockchain technology acts as infrastructure for self-executing smart contracts. ecause contracts are incomplete and some parties are opportunistic, these new contracting possibilities have created challenges of dispute resolution. for instance, will smart contracts be recognised, and any disputes resolved, within the existing courts of jurisdictions? in this paper we first map some institutional governance possibilities for contracting parties (e.g. mediation, private arbitration, courts) to create a dispute resolution possibility frontier (drpf). second, we provide case studies of emerging blockchain-based mechanisms to solve dispute resolution challenges. blockchain-based smart contracts might not only create dispute resolution roblems, but also act as a technology for entrepreneurs to create new mechanisms to solve dispute problems, including those arising from traditional legal contracts. contracting parties will subjectively interpret their most effective governance mechanism to resolve disputes, and the costs of dispute resolution will change over time through a process of institutional innovation.
