بررسی فقهی تعدد زوجات از نگاه فقه و حقوق

چند زنی یا تعدد زوجات واقعیت اجتماعی است که ابعاد گوناگون آن می تواند مورد مطالعه و پذیرش قرار گیرد . از نظر برخی افراد ، چند همسری در زمان های گذشته رسم بوده است و اینک در بیشتر جوامع مرسوم نیست. از نظر گروه دیگر ، تنها اصل تجویز آن در متن دینی ، بر جواز انجام آن کفایت می کند . با توجه به این مسئله که چند همسری تحت عنوان « تعدد زوجات» تابع وجود شرایطی خاص برگرفته از شرع و قانون برای امکان تحقق است ، حمایت از حقوق زنان ، سلامت جامعه و پیامدهای مستقیم و غیر مستقیم چند همسری بر خانواده ، به منزله اساسی ترین نهاد اجتماعی ، اهمیت توجه قانون گذار به این مقوله را دو چندان می کند . اباحه تعدد زوجات به حالت ضرورت و شرایط خاص اجتماعی اختصاص ندارد . رعایت عدالت میان همسران تنها شرط مورد اتفاق در انتخاب چند زنی اگرچه در مفهوم و مصادیق عدالت دیدگاه های گوناگون وجود دارد این پژوهش که با روش توصیفی تحلیلی انجام شده در جهت بررسی فقهی تعدد زوجات از نگاه فقه و حقوق می باشد
