چالش های فقهی، حقوقی و پزشکی در شناسایی افراد ترانس وستیسم

اختلال هویت جنسی، تناقضی میان نقش جنسیتی فرد با جنس جسمانی او است. تناقضی که در دسته ای از افراد مبتلا به این اختلال به دلیل دارا بودن هردو عامل تشخیصی(بیولوژیکی و روانی-اجتماعی) وضوح بیشتری پیدا کرده و به راحتی قابل تشخیص است، اما دسته دیگر که تنها از عامل روانی-اجتماعی برخوردار است با تشخیص دشواری همراه است و یا غالبا نادیده انگاشته می شود. دسته اول که از لحاظ شناسایی و درمان با هیچ مشکلی مواجه نیستند، افراد ترانس سکشوال(trans sexual) می باشند. دسته دوم که متاسفانه هم از لحاظ شناسایی و هم از لحاظ درمانی دارای مشکلات زیادی هستند، افراد ترانس وستیسم(transvestism) می باشند.ترانس وستیسم که شاخه ای از اختلال هویت جنسی است، به دلیل کمبود اطلاعات در زمینه شناخت و شناسایی بعد رفتاری-درمانی مبتلایان، به راحتی با انحرافات جنسی اشتباه گرفته می شود. با وجود این که امکان بیشتری برای ورود این دسته از افراد به سمت و سوی انحرافات و جرایم جنسی، نسبت به شاخه دیگر این اختلال وجود دارد، اما با یک نگاه علّی معلولی به این اصل پی خواهیم برد که در درجه اول، نبود هیچ گونه اطلاعات جامع و رسمی دربار افراد ترانس وستیسم و در درجه دوم، نبود برنامه های درمانی حمایتی برای این افراد، زمینه ساز چنین وقایع تلخ اجتماعی خواهد بود.ما در این پژوهش با اتکا به روش اسنادی سعی داریم با تعمق در دیدگاه های شاخص پزشکی، فقه و حقوق، مفهوم ترانس وستیسم را در خلال مباحث پیرامون اختلال هویت جنسی جست و جو کنیم. چالش های پزشکی در تصدیق عمل جراحی برای این افراد، دسته بندی نادرست این افراد در استفتائات فقهی، عدم در نظر گرفتن حقوق و آزادی های فردی(از قبیل ازدواج و ارث) برای این افراد در نظام حقوقی ایران، از جمله مسائلی است که به آن ها اشاره خواهد شد.

gender identity disorder is a contradiction between one s personality and one s gender. the paradox that is clearer and easily recognizable in one group of people with both diagnostic (biological and psychosocial) factors, but the other group with only psychosocial factors difficulty associated or often overlooked.the first category, which has no problem with identifying and treating them, is trans sexual. the second category, which unfortunately has both diagnostic and therapeutic problems, is transvestism.transvetism, a branch of sexual disorder is easily mistakenly understood with perversion due to absence of information diagnosing the behavioral- therapeutic dimensions of patients. although it is more likely that this group are more capable of conducing to sexual offences in comparison with the people of other groups of the disorder. but with a causal glance we will realize that at the first phase, absence of any comprehensive and formal information about trans people, and at the second phase the lack of supportive treatment programs for these people will be the basis for such social bitter events.in this research we are trying to find out the concept for transvetism during discussions on sexual identity disorder by using documentary methods and considering the medical, jurisprudence and low points of views. medical challenges for confirmation surgery for this group, incorrect classification of them into legal jurisprudence, disregarding of their rights and individual freedoms (such as marriage and inheritance) in iran legislation system are issues which will be mentioned.
