حقوق و کرامت انسانی شهروندان در نظام قضایی اسلام

بین تعالیم اسلام ومفهوم حقوق شهروندی ونیز بین هرسنت الهی دیگر با حقوق شهروندی رابطه ی گسست ناپذیری برقرار است.تعارضاتی که گاه در سنتها با موارد حقوق شهروندی دیده می شود از تعارضات آشتی پذیر و قابل حل است . حقوق شهروندی جدا از حقوق فطری طبیعی و منفک از آن نیست وروح حاکم بر سراسر سنت الهی که در عرف تجلی پیدا کرده است .با توجه به کرامت ذاتی انسان است که پای حق وحقوق به میان کشیده می شود و هر چه انسان اجتماعی تر ومدنی تر می شود،بر شعاع کرامت او افزوده می شود واین شعاع ها همان حقوقی است که از مخزن حقیقی به نام «کرامت»سر بر آورده اند.اصول اساسی حقوق بشر هم چون کرامت انسانی، برابری انسان ها حیات انسانی و آزادی انسانی از دغدغه های اساسی در نظام حقوقی اسلام است .در همین راستا حقوق اسلامی مبتنی بر دایره وسیعی از دستاوردهای بشری است که تاکنون کمتر به آن پرداخته شده است. اهمیت قضاوت و استقلال قضایی دو مقوله حیاتی در بدو شکل گیری حقوق اسلامی بوده است. در زمان پیامبر اکرم (ص) و خلفاء، استقلال قضایی از جایگاه ویژه ای برخوردار بوده و هیچ مقامی حتی خلفا حق دخالت در امر قضاوت را نداشته اند. در این پایاننامه بعد از تعریف قضاوت در اسلام به اهمیت امر قضا طبق آیات و احادیث پرداخته میشود و سپس با اتکا به روایات مستند نمونه هایی از استقلال قضایی در عهد پیامبر (ص) و خلفای راشدین ارائه میگردد.

human rights and dignity of citizens in the judicial system of islamthere is an inseparable relationship between the teachings of islam and the concept of citizenship, as well as between any other divine tradition and citizenship rights. conflicts that are sometimes seen in traditions with cases of citizenship rights can be reconciled and resolved. citizenship rights are not separate from natural rights and separate from it, and the spirit that governs the entire divine tradition that is manifested in custom. it is according to the inherent dignity of human beings that rights and rights are raised, and the more social and civilized human beings are. the radius of his dignity is increased and these radii are the same rights that have emerged from the real reservoir called dignity . the basic principles of human rights such as human dignity, equality of human life and human freedom from the concerns it is fundamental in the islamic legal system.in this regard, islamic law is based on a wide range of human achievements that have been less studied so far. the importance of judgment and judicial independence have been two vital issues since the formation of islamic law. in the time of the holy prophet (pbuh) and the caliphs, judicial independence had a special place and no official, not even the caliphs, had the right to interfere in the judiciary. in this dissertation, after defining judgment in islam, the importance of jurisprudence according to verses and hadiths is discussed and then, relying on documentary narrations, examples of judicial independence in the time of the prophet (pbuh) and the righteous caliphs are presented
